<br />CASSELBERRY CITY COMMISSION <br />Minutes of December 8, 2008 - Regular Meeting <br />Page 17 0(24 <br /> <br />MOTION: <br /> <br />DISCUSSION: <br /> <br />Commissioner Miner moved to denv Resolution 08- <br />1966. Motion was seconded by Commissioner Doerner. <br /> <br />Commissioner Doerner stated there may be some options in the future, but she did <br />not think a fire fee could be considered in the next year unless other alternatives <br />were being looked at. Commissioner Miller stated the citizens spoke loud and clear <br />the last time this issue was addressed that they did not want an additional <br />assessment, and therefore he did not want to even consider reserving the right. <br />Commissioner Miller stated if it was determined that the Fire Department needed <br />more funding, he thought it would be more honest to the citizens to put it in the <br />general fund. Mayor Glancy concurred with Commissioner Doerner and <br />Commissioner Miller's comments and that she did not support assessment fees in <br />any fashion. Mayor Glancy further stated ifthere is a new funding need for the Fire <br />Department, it will have to be addressed in a different fashion. Commissioner <br />Miller and Mayor Glancy announced that their position was not a reflection on the <br />Fire Department and felt the department does an outstanding job. <br /> <br />Motion carried unanimously 5 - 0 by voice vote. <br /> <br />D. Resolution 08-1967 - Imposition and Use of the Uniformed Method of Collecting <br />Non-Ad Valorem Special Assessments for Street Lighting within the City of <br />Casselberry <br /> <br />The City Clerk read Resolution 08-1966 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, ELECTING USE THE <br />UNIFORM METHOD OF COLLECTING NON-AD VALOREM SPECIAL <br />ASSESSMENTS LEVIED WITHIN THE INCORPORATED AREA OF THE CITY ; <br />STATING A NEED FOR SUCH LEVY; PROVIDING FOR THE MAILING OF THIS <br />RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE." <br /> <br />Notice of Public Hearing: The Notice of Public Hearing relative to Resolution 08-1967 was published in <br />the Orlando Sentinel on November 2, 9, 16 and 23, 2008. <br /> <br />Staff Presentation: Ms. Barbara Lipscomb, City Manager stated Resolution 08-1967 preserves the City's <br />ability to reconsider the use of the uniform method of collecting non-ad valorem assessments for street <br />lighting services. In order to use this methodology in 2009, Florida Statutes require that a public hearing be <br />conducted on or before January 1,2009, and adopt a resolution providing notice of intent to utilize non-ad <br />valorem special assessments and the tax bill collection method for funding the provision of street lighting <br />services to property owners within the corporate limits of the City with some exclusions such as private <br />subdivisions that pay their street lighting costs through their homeowners association. Resolution 08-1967 <br />does not obligate the City to impose the special assessment, but only preserves the City's opportunity to <br />utilize the tax bill collection method beginning in November 2009, and is necessary to meet statutorily <br />
