Resolution 08-1966 - Imposition and Use of the Uniformed Method of Collecting <br />Non-Ad Valorem Special Assessments for Fire Protection Services within the City <br />of Casselberrv <br /> <br />The City Clerk read Resolution 08- 1966 by title as follows: <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, ELECTING USE THE <br />UNIFORM METHOD OF COLLECTING NON-AD VALOREM SPECIAL <br />ASSESSMENTS LEVIED WITHIN THE INCORPORATED AREA OF THE CITY ; <br />STATING A NEED FOR SUCH LEVY; PROVIDING FOR THE MAILING OF THIS <br />RESOLUTION; AND PROVIDING FOR AN EFFECTIVE DATE." <br /> <br />Notice of Public Hearing: The Notice of Public Hearing relative to Resolution 08-1966 was published in <br />the Orlando Sentinel on November 2,9, 16 and 23, 2008. <br /> <br />Staff Presentation: Ms. Barbara Lipscomb, City Manager stated Resolution 08-1966 preserves the City's <br />ability to reconsider the use of the uniform method of collecting non-ad valorem assessments for fire <br />protection services. In order to use this methodology in 2009, Florida Statutes require that a public hearing <br />be conducted on or before January 1,2009, and adopt a resolution providing notice of intent to utilize non-ad <br />valorem special assessments and the tax bill collection method for funding the provision of fire protection <br />services to property owners within the corporate limits of the City. Resolution 08-1966 does not obligate <br />the City to impose the special assessment, but only preserves the City's opportunity to utilize the tax bill <br />collection method beginning in November 2009, and is necessary to meet statutorily imposed notice required <br />specified in F. S. 197.3632. If adopted, copies ofthe resolution must be sent to the Seminole County Tax <br />Collector, the Seminole County Property Appraiser and the Florida Department of Revenue by January 10, <br />2009. However, this resolution is non-binding and the City Commission may reduce the areas covered by <br />any future assessments or decide not to proceed with this assessment program at a later date. <br /> <br />Budget Impact: This item has no impact to the City Budget. <br /> <br />Recommendation: The City Manager and the Fire Chief recommended approval of Resolution 08-1966. <br /> <br />Public Hearing: The following individual came forward and addressed Resolution 08-1966: <br /> <br />I) Mr. John Horvath, 1004 Bradford Drive, Winter Park, Unincorporated Seminole County, <br />stated he was speaking on behalf of his daughter who owns property in the City of <br />Casselberry. Mr. Horvath stated he was retired firefighter and was aware of all the changes <br />and needs of a fire department, and felt that counties and cities need to figure out how to <br />work together in order to better serve the taxpayers, as long as any proposed fee was not <br />higher than what the ad valorem millage would be. <br /> <br />No one else came forward. Mayor Glancy closed the public hearing relative to Resolution 08-1966. <br />
