Part II, Section 2-210: Provides revisions to the schedule of fines provided for Code <br />Enforcement Citations. <br />2. Part II, Chapter 14-34: Provides an opportunity to request additional special events, open <br />air and open air food sales events. <br />3. Part II, Chapter 14-42(a): Removes code language that allows a request for additional <br />special event opportunities. <br />4. Part II, Chapter 14-52: Provides the City Manager the discretion regarding open air sales <br />opportunities in the ROS (recreation & open space) zoning district. <br />When this ordinance was reviewed by the Planning and Zoning Commission, staff <br />recommended amending the criteria for "Open Air Food Sales" in Chapter 14-53. A <br />further review of the requirements indicates that the opportunity for "farmer market" type <br />uses would be more appropriate as an "Open Air Sale"; therefore, staff amended the <br />ordinance provided to the City Commission to include this change. <br />5. Part III, Table 2-5.3: Replace a conditional use review for "bars and lounges" with <br />"alcoholic beverage sales for on-site consumption". <br />6. Part III, Table 2-5.4 footnotes: Provides the City Manager with the discretion to determine <br />major construction in the ROS (recreation & open space) zoning district that requires City <br />Commission review. <br />7. Part III, Section 3-16.9: Adds the six-second minimum sign message requirement for <br />legally existing non-conforming animated signs. <br /> <br />Budget Impact: This item does not impact the City Budget. <br /> <br />Recommendation: The City Manager and the Community Development Director recommended approval <br />of Ordinance 09-1262 on first reading. <br /> <br />Public Hearing: The following individual came forward and addressed Ordinance 09-1262: <br /> <br />I) Mr. Craig Tull, 420 Ranch Trail, voiced concerns about the amount of changes in the <br />ordinance and said it was hard to follow. <br /> <br />No one else came forward. Mayor Glancy closed the public hearing relative to Ordinance 09-1262. <br /> <br />MOTION: <br /> <br />Commissioner Solomon moved to approve Ordinance <br />09-1262 on first reading, as preseuted. Motion was <br />seconded by Commissioner MUler. Motion carried <br />unanimously by voice vote 5 - O. <br />
