Office holders shall serve the office to which they were elected and sworn until their successor is sworn, seated and assumes office. Upon assumption of office, the Commission shall organize itself for the purpose of transacting any and all necessary lawful business of the City. (Ref. of 12-6-83; Ref. of 9-2-86; Ord. No. 94-808, S I, adopted July 18, 1994, and approved by referendum in public elections Nov. 8, 1994, and effective Jan. 1, 1996, set out provisions amending the first paragraph of S 16 by repealing the language following the words "assume the duties and responsibilities of office" and substituting new language as set out above. The old provisions read "upon the second Monday in December following the regular City election in which they were elected." Section 4.14. Sell. 17. Regular meeting. The City Commission shall meet regularly at such times and at such places as may be specified by Ordinance, except that it shall meet regularly not less than once each month. (Ord. No. 680, 9-17-90/11-6-90) Section 4.15. Sell. 18. Special meetings. The City Manager or any two (2) members of the Commission may call special meetings of the Commission, upon at least twenty-four (24) hours' written notice to each member, served personally or left at his or her usual place of residence, or place of business. All official meetings of the City Commission shall be public, and any citizen shall have access to the minutes and records thereof at all reasonable times. These records will be reviewed in the presence of the City Manager or the City Clerk. (Ord. No. 680, 9-17-90/11-6-90; Ord. No. 714, S 1,11-18-91) Section 4.16. Sell. 19. Legislative procedure. A majority of all members elected to the City Commission shall constitute a quorum, but a less number may adjourn from day to day and compel the attendance of absent members in such a manner and under such penalties as may be prescribed by Ordinance. The affirmative vote of three (3) members shall be necessary to adopt any Ordinance or Resolution, except as specifically required by S 157.296 [the City zoning Ordinance], City Code, and the passage of all Ordinances and Resolutions shall be taken by "yeas" and "nays" and entered upon the journal. It shall keep a journal of its proceedings, and the journal shall be open to public inspection. (Ord. No. 680, 9-17-90/11-6-90) ARTICLE V. CITY MANAGER Section 5.01. Sell. 23. Appointment; qualifications; compensation. The City Commission shall appoint a City Manager for an indefinite term by a majority vote of all of the Commissioners and fix his or her compensation.
