<br />either publicly or privately. The Commission and City Manager agree to mutually <br />respect and abide by their respective roles and duties. Nothing in this Section <br />shall be interpreted to mean that Commission members cannot speak to any City <br />officer or employee at a reasonable time and place for reasonable purposes. <br /> <br />Section 4.08. Sell. 14. Vacancy in the Office of City Commission Membel'l. <br />If any vacancy occurs in the City Commission, the City Commission shall fill the vacancy <br />until the next regular municipal election, at which time the vacancy in such office shall be filled <br />for the unexpired term, if any. In the event a vacancy occurs in the Mayor's seat, the City <br />Commission shall fill the vacancy until the next regular municipal election, at which time the <br />vacancy in such office shall be filled for the unexpired term, if any. If the Commission fails to do <br />so within thirty days following the occurrence of the vacancy, the City Clerk shall call a special <br />election to fill the vacancy, to be held not sooner than ninety days and not later than 120 days <br />following the occurrence of the vacancy, and to be otherwise governed by law. <br /> <br />Section 4.09. Sell. 15. Time limit for filling vacancies. <br />Any vacancy in the office of the Mayor or Commission member shall be filled by action <br />of the City Commission not later than the second regular Commission meeting following the <br />vacancy. <br />(Ord. Commission to be judge of qualifications of its members. <br />The Commission shall be the judge of the election and qualifications of its members, but <br />the decision of the Commission in any such case shall be subject to review by the courts. In no <br />case shall qualifications be less than those defined in this Charter. <br />(Ord. No. 680, 9-17-90/11-6-90) <br /> <br />Section 4.11. Investigations. <br />The City Commission may make investigations into the affairs of the City and the <br />conduct of any City department, office, or agency. <br /> <br />Section 4.12. Sell. 22. Independent annual certified audit. <br />Prior to the end of each fiscal year, the Commission shall designate qualified public <br />accountants who, as of the end of the fiscal year, shall make an independent certified audit of <br />accounts and other evidences of financial transactions of the City government and shall submit <br />their report to the City Commission. Such accountants shall have no personal interest, direct or <br />indirect, in the fiscal affairs of the City government or of any of its officers. They shall not <br />maintain any accounts or records of the City business, but within specifications approved by the <br />Commission, post-audit the books and documents kept by the Treasurer and any separate or <br />subordinate accounts kept by any other office, department or agency of the City government. <br />(Ord. Assumption of office and establishment of organizational <br />meeting. <br />After expiration of the regular terms of those officials in office at the time of the effective <br />date of this Section, all future elected officials to the office of Mayor or City Commission shall be <br />sworn, seated and assume the duties and responsibilities of office at the next regular meeting <br />or special called meeting of the City Commission immediately following certification of the <br />election in which the member was elected to office. <br /> <br />5 <br />
