<br />Manager need not be a resident of the City or state at the time of the appointment but shall <br />become a resident of the City of Casselberry, Florida, within six (6) months from the effective <br />date of the appointment to the position of City Manager. <br />(Ref. of 9-2-86; Ord. No. 680, S V, 9-17-90/11-6-90) <br /> <br />Section 5.02. Sell. 24. Removal. <br />The City Commission may remove the City Manager from office in accordance with the <br />following procedures: <br /> <br />ill a- The City Commission shall adopt by affirmative vote of a majority of all its <br />members a preliminary resolution which must state the reason for removal and <br />may suspend the City Manager from duty for a period not to exceed forty-five <br />(4S) consecutive calendar days. A copy of the Resolution shall be delivered <br />promptly to the City Manager. <br /> <br />~ b,. Within five (S) days after a copy of the Resolution is delivered to the City <br />Manager, the City Manager may file with the Commission a written request for a <br />public hearing. This hearing shall be held at a Commission meeting not earlier <br />than fifteen (1S) days nor more than thirty (30) days after the request is filed. The <br />City Manager may file with the City Commission a written reply not later than five <br />(S) days before the public hearing. <br /> <br />,Ql &- The Commission may adopt a final Resolution of removal, which may be made <br />effective immediately, by affirmative vote of a majority of all its members at any <br />time after five (S) days from the date when a copy of the preliminary Resolution <br />was delivered to the City Manager, if the City Manager has not requested a <br />public hearing, or at anytime after the public hearing if the City Manager has <br />requested one. <br /> <br />~ EI, The City Manager shall continue to receive his or her salary until the effective <br />date of a final Resolution of removal. <br />(Ord. No. 680, S V, 9-17-90/11-6-90) <br /> <br />Section 5.03. Sell. 25. Acting City Manager. <br />By letter filed with the City Clerk, the City Manager shall designate, subject to approval <br />of the Commission, a qualified City administrative officer to exercise the powers and perform <br />the duties of the City Manager during the City Manager's temporary absence or disability. <br />During such absence or disability, the Commission may revoke such designation at any time <br />and appoint another officer of the City to serve until the City Manager shall return. <br />(Ord. No. 680, S V, 9-17-90/11-6-90) <br /> <br />Section 5.04. Sell. 2&. Powers and Duties of City Manager. <br />The City Manager shall be the chief executive officer of the City, responsible to the <br />Commission for the management of all City affairs placed in the Manager's charge by or under <br />this Charter. The City Manager shall: <br /> <br />(1) Appoint and, when the City Manager deems it necessary for the good of the City, <br />suspend or remove City employees, except as otherwise provided by this <br />Charter or by law. The City Manager may, with approval of the City Commission, <br />hire, suspend, or remove department head employees. <br /> <br />7 <br />
