<br />(x) Street. Open public right-of-way or dedicated right-of-way with passable access <br />or private road access. <br />(y) Tag. Informative literature left at a Dwelling Unit by Contractor when Solid <br />Waste, Recyclables, or Yard Waste are not acceptable for collection. <br />(z) Training Program. Contractor's employee training program. The program shall <br />include customer service and contract requirements training and driver route, safety, <br />environmental, and equipment training. <br />(aa) Uncontrollable Forces. An event which results in the prevention or delay of <br />performance by a party of its obligation under this Agreement which is beyond the reasonable <br />control of the non-performing party. It includes, but is not limited to, fire, flood, hurricanes, <br />earthquakes, storms, lightning, epidemic, war, riot, civil disturbance, and sabotage. <br />(bb) White Goods. Inoperative and discarded refrigerators, ranges, washers, water <br />heaters, freezers, and other similar large, domestic appliances. <br /> <br /> <br />(cc ) Yard Waste. Vegetative matter resulting from landscaping maintenance, and <br /> <br /> <br />includes materials such as tree and shrub trimmings, grass clippings, and palm fronds generated <br /> <br /> <br />by a Customer from a Dwelling Unit in the Service Area Yard Waste items shall not exceed <br /> <br /> <br />four (4) feet in length, four (4) inches in diameter, or fifty (50) pounds in weight, and shall not <br /> <br /> <br />include C&D, or home improvement and remodeling debris. Natural Christmas trees shall be <br /> <br /> <br />collected annually as Yard Waste from all homes in the Service Area. <br /> <br /> <br />Section 2. Term. <br /> <br /> <br />(a) Subject to the termination provisions contained in Section 9 of this Agreement, <br /> <br /> <br />the term of this Agreement shall be for a twelve month (12) period beginning January 1,2009 <br /> <br /> <br />and ending December 31,2009, unless terminated earlier as provided herein. <br /> <br />7 <br />
