<br />(b) During the Agreement, the parties may mutually agree to extend the terms and <br />conditions of this Agreement up to two (2) separate one (1) year renewals, when it is in their best <br />interests to do so. The parties' option to extend this Agreement does not obligate either party to <br />agree to extend the Agreement, nor is it intended to vest any contract or property right in either <br />party related to term extensions. In the event that the parties do not extend this Agreement, the <br />City may solicit bids, requests for proposal, or provide such services in the manner that the City <br />deems to be in its best interests. Furthermore, any rate adjustments during each one (1) year <br />renewal shall be governed by Section 6, no other adjustments may be negotiated during the one <br />(1) year renewal. <br />Section 3. Commencement of Services. The services provided by Contractor under this <br /> <br /> <br />Agreement shall cornmence effective January 1,2009. <br /> <br /> <br />Section 4. Services Provided by Contractor. The Contractor shall provide services to <br /> <br /> <br />the eight (8) City of Casselberry Facilities, which include the Water Reclamation Plant, Public <br /> <br /> <br />works Compound, Fire Stations #21 & 25, City Hall, Parks Department, Senior Center and the <br /> <br /> <br />South Water Plant at last once a week or as specified in the request for proposals. <br /> <br /> <br />Section 5. City of Casselberry's Billing, Collection and Payment Obligations. The <br /> <br /> <br />Contractor will invoice the City monthly for services completed during the month and in <br /> <br /> <br />accordance with the proposal dated November 12, 2008. The City will process payment in <br /> <br /> <br />accordance with the current Purchasing policy. The City agrees to pay for all commercial waste <br /> <br /> <br />containers, hauling and disposal provided and completed each month. <br /> <br /> <br />Section 6. Rate Adjustments. Extraordinary Rate Adjustments. <br /> <br /> <br />(a) Contractor may petition the City at any time for an additional rate <br /> <br /> <br />adjustment on the basis of extraordinary and unusual changes in the cost of operations that could <br /> <br />8 <br />
