<br />CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />OCTOBER 09, 2008 PAGE 6 <br /> <br />Kathleen A. Hale made a motion to fmd Respondent in CEB Case # 08-02301 in violation of City Code, <br />Section 70-2 (C), and that such violation constitutes a serious threat to the public health, safety and <br />welfare, and that Respondent shall correct the violation before 1 :00 p.m., 10/23/2008. I further move that <br />should Respondent fail to correct the violation on or before the aforesaid day, that a fme in the amount of <br />$ 25.00 per day will be imposed for each and every day the violation continues. Pursuant to Sections 2- <br />150(d) and 2-153(a) of the City Code and Section 162.06(4) and 162.09(1), Florida Statutes, the Board <br />requests that the City be notified and that appropriate action be taken to accomplish all reasonable <br />repairs or provide all services necessary, proper or required to bring Respondent's property into <br />compliance, and that the City of Casselberry be entitled to recover its reasonable costs of such repairs or <br />services as part of the Final Order. The Respondent is further ordered to contact the Code Inspector to <br />verify compliance with this Order. <br /> <br />A Subsequent Hearing will be held before this Board on 11/13/2008 to determine compliance by the <br />aforestated date, and, if there is no compliance, that the violation be deemed a repeat violation from the <br />compliance date of the Board's prior Order. <br /> <br />Charlene Glancy seconded the motion. <br /> <br />The motion passed unanimously. <br /> <br />Foreclosure Decisions <br /> <br />CE-07-00867 317 S. Sunset Drive SAMO HT CORP./owner Trash & debris 70-1 (C) <br /> <br />Ketron Brown, Code Enforcement Supervisor advised that this case was being presented for a recommendation <br />to pursue foreclosure or other action to collect fines imposed on this property. This case was first heard by the <br />CEB on 07/12/2007, a Finding of Fact was issued, along with a $50.00 per day fine imposed if the property was <br />not in compliance. A Subsequent Hearing was held on 08/09/2007, the property remained non-compliant at that <br />time. The Order Imposing Fine was recorded on 08/28/2007 in Seminole County public records. On 09111/2007 <br />the property was found in compliance, the fine ran for 47 days, a total of $2,350.00 remains outstanding. The <br />City was asking for the Board to pursue appropriate actions to collect the fine imposed on the property. <br /> <br />Robert C. Flint stated this was a wetland procedure, with trash on the side. <br /> <br />Charlene Glancy stated the trash and debris and the wetland issue are two separate issues. <br /> <br />Discussion. <br /> <br />Multiple Board members stated the owner was present. <br /> <br />Debra Babb-Nutcher stated the owner had the right to speak. <br /> <br />Tom Hendricks, 120 Magnolia Drive, Altamonte Springs, Fl advised the CEB that he is with SAMO Corp. and <br />Mr. Fouroozi is the general contractor. Mr. Hendricks stated he was not aware of this situation until he got the <br />registered letter last week. Mr. Hendricks stated he searched his records, and all he knew was they had a <br />contractor there cleaning up the property on 08/01/2007, which is when he wrote out the check. That should be <br />the date, because they did not have any other clean-up costs, he was at a loss of what actually transpired. No <br />records could be found on his end. <br />
