<br />CITY OF CASSELBERRY <br />CODE ENFORCEMENT BOARD MEETING <br />OCTOBER 09,2008 PAGE 5 <br /> <br />Charlene Glancy made a motion that Respondent in CEB Case # 08-02342 did not comply with the Code <br />Enforcement Board's Order of 09/16/2008 by the date specified in that Order and that the fme will be <br />imposed as set forth in that Order. <br /> <br />Alvera Armour seconded the motion. <br /> <br />The motion passed unanimously. <br /> <br />NEW CASES <br /> <br />CE-08-00617 1153 Park Drive Colon, Yanire & Machado, Abraham/owners no water <br />service 302.3 SHC 1994 ED <br /> <br />Marlene Broman, Code Enforcement Officer gave testimony for the above case. This complaint came from the <br />utility department on 03/27/2008 that there was no water service at this location. CES Broman stated as of <br />10/09/2008 there has been no compliance, the account is in collections, and there is an outstanding balance of <br />$549.79 in order for the water to be turned back on. There is also a Lis Pendens filed on this property on <br />05/08/2007. The City requested a Finding of Fact and a reasonable fine be imposed if found to be non- <br />compliant by the date set by the Code Board. <br /> <br />Robert C. Flint made a motion to fmd Respondents in CEB Case # 08-00617 in violation of City Code, <br />Section 302.3 SHC, and that Respondents correct the violation before 1:00 pm 10/23/2008. Another <br />Hearing will be held before this Board on 11/1312008 to determine compliance by the aforestated date, <br />and, if there is no compliance by the aforestated date, a fine in the amount of $25.00 per day will be <br />imposed for each and every day the violation continues past the aforestated date. The respondents are <br />further ordered to contact the Code Inspector to verify compliance with this Order. <br /> <br />Alvera Armour seconded the motion. <br /> <br />The motion passed unanimously. <br /> <br />CE-08-02301 1565 Oak Lane Paz.. Brenda/owner Overgrown property 70-2(C) <br /> <br />Marlene Broman, Code Enforcement Officer, gave testimony for the above case. This violation was observed <br />during a neighborhood inspection on 08/14/2008. As of 10/09/2008 there has been no compliance. A Lis <br />Pendens was filed on this property on 09/20/2007. There has been no response from the owner. <br /> <br />Ketron Brown, Code Enforcement Supervisor, advised that given the nature of the case the city was asking for <br />an Order to abate, in the event the owner does not comply by the date set forth established by the Board, due to <br />this being a threat to the community, public safety and welfare. <br /> <br />CEO Broman stated she was asking for a Finding of Fact and a reasonable fine imposed if found to be non- <br />compliant by the date set forth by the Board. <br />
