CITY OF CASSELBERRY CODE ENFORCEMENT BOARD MEETING OCTOBER 09,2008 PAGE 5 Charlene Glancy made a motion that Respondent in CEB Case # 08-02342 did not comply with the Code Enforcement Board's Order of 09/16/2008 by the date specified in that Order and that the fme will be imposed as set forth in that Order. Alvera Armour seconded the motion. The motion passed unanimously. NEW CASES CE-08-00617 1153 Park Drive Colon, Yanire & Machado, Abraham/owners no water service 302.3 SHC 1994 ED Marlene Broman, Code Enforcement Officer gave testimony for the above case. This complaint came from the utility department on 03/27/2008 that there was no water service at this location. CES Broman stated as of 10/09/2008 there has been no compliance, the account is in collections, and there is an outstanding balance of $549.79 in order for the water to be turned back on. There is also a Lis Pendens filed on this property on 05/08/2007. The City requested a Finding of Fact and a reasonable fine be imposed if found to be non- compliant by the date set by the Code Board. Robert C. Flint made a motion to fmd Respondents in CEB Case # 08-00617 in violation of City Code, Section 302.3 SHC, and that Respondents correct the violation before 1:00 pm 10/23/2008. Another Hearing will be held before this Board on 11/1312008 to determine compliance by the aforestated date, and, if there is no compliance by the aforestated date, a fine in the amount of $25.00 per day will be imposed for each and every day the violation continues past the aforestated date. The respondents are further ordered to contact the Code Inspector to verify compliance with this Order. Alvera Armour seconded the motion. The motion passed unanimously. CE-08-02301 1565 Oak Lane Paz.. Brenda/owner Overgrown property 70-2(C) Marlene Broman, Code Enforcement Officer, gave testimony for the above case. This violation was observed during a neighborhood inspection on 08/14/2008. As of 10/09/2008 there has been no compliance. A Lis Pendens was filed on this property on 09/20/2007. There has been no response from the owner. Ketron Brown, Code Enforcement Supervisor, advised that given the nature of the case the city was asking for an Order to abate, in the event the owner does not comply by the date set forth established by the Board, due to this being a threat to the community, public safety and welfare. CEO Broman stated she was asking for a Finding of Fact and a reasonable fine imposed if found to be non- compliant by the date set forth by the Board.
