Regular Meeting <br />Page]80f2l <br /> <br />DISCUSSION: <br /> <br />Commissioner Doerner stated she was disappointed with the proposed <br />standards because of the utilization of passive language such as "should" <br />and "encouraged" rather than "shall" and "will". <br /> <br />Motion carried 4 - 1 (Commissioner Doerner dissenting) by voice vote. <br /> <br />Mayor Goff declared a recess at 8:55 p.m. The meeting was reconvened at 9:02 p.m. <br /> <br />12. OTHER ITEMS <br /> <br />A. Code Lien Reduction Request - Code Board Case 05-01557 - Property Owner: 4200 <br />S. U.S. Highwav 17-92 LLC (Thomas Sheen) <br /> <br />Staff Presentation: Deputy Police Chief Jim Ruf stated per Ordinance 06-1176, the Code Enforcement <br />Board has requested the City Commission consider a reduction of lien for the business located at 105 West <br />Melody Lane owned by Mr. Thomas Sheen. On August 14, 2008, the Code Enforcement Board heard a <br />request from the property owner's attorney, Mr. Larry Kosto, for a reduction or waiver of fine/lien. Mr. <br />Kosto stated that the property owner was unaware of the violation due to an out-of-date address on the <br />Property Appraiser's record. The Code Enforcement Board agreed that there was no evidence that the <br />property owner had ever received notice of the violation. The Code Enforcement Board indicated that the <br />property owner still had some limited liability and should have been checking on the property even though <br />he lives out of the area. Subsequently, the Board is requesting a reduction of the fine from $25,000 to <br />$2,500. <br /> <br />Budget Impact: The money collected would contribute to revenue for code enforcement fines budgeted in <br />the General Fund. <br /> <br />Recommendation: The City Manager and the Police Chief recommended approval ofthe Code Enforcement <br />Board's recommended reduction in fines from $25,000 to $2,500. <br /> <br />Audience Input: The following individual came forward to address the Code Lien Reduction Request: <br /> <br />1) Mr. Larry Kosto, 619 East Washington Street, Orlando, stated he was the attorney for the <br />property owner and requested that the City Commission reduce the fine to $2,500. <br /> <br />MOTION: <br /> <br />Commissioner Miller moved to reduce the fine <br />assoeiated with Code Board Case 05-01557, Property <br />Owner 4200 S, U.S. Highway 17-92 LLC (Thomas <br />Sheen) from 525,000 to 52,500, as recommended by the <br />Code Enforcement Board. Motion was seconded by <br />Commissioner Solomon. Motion carried unanimously <br />by voice vote 5 - O. <br />
