<br />WHEREAS, the City of Casselberry's Comprehensive Plan, Future Land Use Policy 10.2, <br /> <br />directs Small Area Studies to "be conducted to identify strategies for physically and functionally <br /> <br />redeveloping areas into a mixture of land uses with the intent of making these areas more <br /> <br />economically viable and livable"; and <br /> <br />WHEREAS, the City of Casselberry's Comprehensive Plan, in Future Land Use Policy <br /> <br />10.3, authorizes the City Commission to adopt future land use, zoning and other design standards <br /> <br />applicable to the redevelopment of a Small Study Area; and <br /> <br />WHEREAS, the Casselberry City Commission finds it to be in the best interest of the City, <br /> <br />its citizens and property owners, to encourage planned, compatible and profitable development as <br /> <br />provided within the Small Area Studies; and <br /> <br />WHEREAS, the Casselberry City Commission formally adopted Resolution Number 08- <br /> <br />1890 on June 23, 2008, the "Transportation Concurrency Exception Area Study" conducted by <br /> <br />Kimley Horn; and <br /> <br />WHEREAS, the properties within the Transportation Concurrency Exception Area (TCEA) <br /> <br />are zoned Commercial General and PMX-H (Planned Mix Use: High Intensity), zoning districts <br /> <br />which allow primarily commercial and a limited amount of residential uses, and; <br /> <br />WHEREAS, the Future Land Use Map (FLUM) of the City's Comprehensive Plan currently <br /> <br />designates the study area property as Commercial and High Intensity Non-Residential I Medium <br /> <br />Density Residential, which allows residential density of up to 13 dwelling units per acre and non- <br /> <br />residential intensity of up to .50 Floor Area Ratio (FAR); and <br /> <br />WHEREAS, certain modifications and additions to the City's zoning regulations and land <br />uses are needed, as authorized by Future Land Use Policy 7.1 of the City's Comprehensive Plan; <br />and <br /> <br />Page 2 of 18 <br />Comp Plan Policy Amendments <br />Ordinance 08-1240 <br />
