<br />WHEREAS, the City of Casselberry's Comprehensive Plan, Future Land Use Objective 5 <br /> <br />discourages the proliferation of urban sprawl by encouraging infill development and <br /> <br />redevelopment of properties which are underutilized; and <br /> <br />WHEREAS, the Transportation Concurrency Exception Study forms the basis for a new <br /> <br />overlay zoning district to be entitled the "Transportation Concurrency Exception Area (TCEA)" as <br /> <br />authorized in Future Land Use Policy 7.1 and 10.3 of the City's Comprehensive Plan; and <br /> <br />WHEREAS, the Transportation Concurrency Exception Area Study provides the criteria <br /> <br />for a new Future Land Use designation entitled "Major Thoroughfare Mixed-Use" which allows <br /> <br />residential density of up to 30 dwelling units per acre and non-residential intensity of up to 1.50 <br /> <br />Floor Area Ratio (FAR); and <br /> <br />WHEREAS, two underutilized redevelopment sites are located within the Transportation <br /> <br />Concurrency Exception Area commonly referred to as "Concord Center" and "City Center" and <br /> <br />they have zoning and future land use designations that underutilize the properties; and <br />WHEREAS, the Casselberry City Commission finds this Ordinance serves a legitimate <br /> <br />governmental interest in preserving the quality of urban life by discouraging the proliferation of <br /> <br />urban sprawl and encouraging the redevelopment of infill properties per Objectives 2, 3 and 5 of <br /> <br />the Future Land Use Element of the City's Comprehensive Plan; and <br /> <br /> <br />WHEREAS, the Casselberry Planning and Zoning Commission I Local Planning Agency, <br /> <br />reviewed this ordinance and found it to be consistent with the City's Comprehensive Plan; and <br /> <br />WHEREAS, words with double underlined type shall constitute additions to the original <br /> <br /> <br />text and strike through shall constitute deletions to the original text. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF <br />CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />Page 3 of 16 <br />Comp Plan Policy Amendments <br />Ordinance 08-1240 <br />
