<br />Planning & Zoning Commission! <br />Local Planning Agency <br />September 27.2006 <br />Page 3 of 5 <br /> <br />Mr. Henson amended his motion to address changing the site plan to address the correction to the tree <br /> <br />specifications. Mr. Van Meter seconded the motion. The motion passed unanimously by voice vote. <br /> <br />Third Item of Business: SP 06-02: John Hartman. Lot Split. Property located at 160 Marion Lane, <br />Casselberry, Florida. <br /> <br />Mr. Charles Senzee, Planner, reviewed the information provided in his memorandum dated September 21 , <br /> <br />2006, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br /> <br />Department). Mr. <br /> <br />requested the Planning and Zoning Commission recommend approval to the City <br /> <br />Commission for SP 06-02 for the Marion Lane Lot Split plat for the property located at 160 Marion Lane, Casselberry, <br />Florida, based on the information provided in the staff report dated September , 2006, the plat received August 29, <br /> <br />2006 and subject to the conditions outlined in the staff report which were: <br /> <br />1. The staff required revisions to the plat (findings of fact # 7) shall be made to the plat and the City <br />Surveyor shall execute the signature block prior to referral of the final plat to the City Commission. <br />2. The final plat shall be submitted in the following form prior to review by the City Commission: (14) 11" x <br />17" copies and (2) 20" x 24" copies. <br />3. The applicant, per F.S. Chapter 177, is responsible for the City Surveyor's fees. Prior to recording the <br />final plat, the applicant shall submit a check made payable to the "City of Casselberry" to cover the City <br />surveyor's fees. <br />4. After City Commission approval, the applicant shall provide the City with a check for the recording fees <br />(made payable to "Seminole County"), (1) executed mylar of the recorded plat, and any other <br />information requested as part of compliance to Chapter 177. <br /> <br />A discussion ensued regarding access to the property. Mr. John Hartman, 160 Marion Lane, Casselberry, <br />Florida came forward. Mr. Hartman said he currently lives on the property. He said he has worked with the City to <br /> <br />construct the lift station and to provide water and sewer to the property. Mr. Hartman stated that Marion Lane is the <br /> <br />only access to the property. Mr. Hartman said he has a notarized statement from the property owner giving him and <br /> <br />the adjacent property owners access rights. <br />Ms. Smith suggested continuing this item to allow Mr. Hartman an opportunity to obtain an easement. <br />The Planning and Zoning Commission expressed concerns with the emergency access, stormwater <br />retention and maintenance of the road. A brief discussion ensued regarding the lift station and the force main. Mr. <br /> <br />Hartman said the force main is located in the easement and goes into Lake Kathryn and down to Lake Kathryn <br /> <br />Circle. <br />
