<br />request. Mr, John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward, Mr, Casselberry said he has

<br />not read the staff report but expressed a concern with emergency access in the side yards. Mr, Casselberry said he reviewed
<br />
<br />the Centex building permits and the permits do not identify
<br />
<br />
<br />entity, Mr. Casselberry was concerned with liability

<br />presented, Mr. Van Meter seconded the motion. The motion passed unanimously by voice vote,

<br />Third Item of Business: SPR 06-03, SP 06-01 & CU 06.12: Cambridae Oaks. Site plan and preliminary plat review for a
<br />new retail complex at the southwest corner of Plumosa and US Highway 17-92. Conditional use request for height of
<br />building.

<br />Ms. Sandra Smith, Acting Community Development Director, reviewed the information provided in her memorandum
<br />
<br />dated August 4, 2006, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community
<br />
<br />Development Department). Ms, Smith requested the Planning and Zoning Commission recommend approval of SPR 06-0S,
<br />
<br />site plan for Cambridge Oaks office-retail center, located on US Highway 17-92, based on the information provided in the staff
<br />
<br />report dated August 4, 2006, the site plan dated June 2S, 2006 (Exhibit B), and the following conditions:
<br />
<br />1, The Planning and Zoning Commission approves the following modifications:
<br />a) Allow Lot 2 to share the existing 10' wide northern landscape strip provided by Lot 1 rather than requiring an
<br />additional 1 0' wide landscape strip on the southern perimeter of Lot 2.
<br />b) Allow 31 % of the parking on Lot 1 to be 9' X 18' rather than the standard 10' X 20'.
<br />c) Allow the 50% encroachment into the required buffer area to be utilized for an internal roadway rather than open
<br />space.
<br />2, Contribution to the City Tree Bank, due to the removal of 336 trees, in the amount of $84,000 for Lot 1 and $71,000
<br />for Lot 2,
<br />3, All Public Works issues must be addressed prior to issuance of a site construction permit.
<br />
<br />A brief discussion ensued regarding the removal of the trees for Lot 2. Mr. Kelley asked the applicant to come
<br />
<br />forward, Mr. Mikal Hale, Kimly Horn, 851 Dunlawton, Port Orange, Florida, and Mr, Will Reynolds, CRF-Maitland, 500 South
<br />Florida Avenue, Lakeland, Florida came forward. Mr, Hale said the mass grading would impact the trees. Mr. Reynolds said
<br />
<br />they are willing to take on the responsibility of the removal of trees at this time, Mr, Reynolds said the trees are being
<br />
<br />removed at this time due to grading and for visibility purposes.
