Mr. Coto said the St. John's River Water Management District's permit also requires maintenance of <br /> <br />the stormwater. <br /> <br />Mr. Coto stated that the property owner at 1043 Seminola Boulevard has changed his access to the east side of <br /> <br />the property. <br /> <br />Mr. Kelley asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br /> <br />request. Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. Casselberry <br /> <br />questioned the landscaping requirements and the removal of a reverse osmosis pollution pump that was originally located <br /> <br />on the site. <br /> <br />Mr. Kelley asked for a motion to address SPR 05-13. Mr. Buchanan recommended approval of SPR 05-13 based <br /> <br />on staff's recommendations in the staff report dated June 29, 2006 to the Planning and Zoning Commission including the <br /> <br />following changes: <br /> <br />1. Modifying condition 3b to read: "No vehicular sales, service, or leasing shall be conducted on the <br />1043 and 1059 Seminola Boulevard property without obtaining approval via conditional use. <br /> <br />2. Add condition no. 9 to read: "The applicant is required to submit a site photometric plan that <br />complies with the City Code prior to issuance of a construction permit'. <br /> <br />3. Add condition no. 10 to state: "Property owner documents, covenants, restrictions and easements <br />documentation must be recorded and submitted to the City prior to the issuance of a building permit. <br /> <br />Mr. Weinroth seconded the motion. The motion passed unanimously by voice vote. <br /> <br />Third Item of Business: CU 06-13: TimiQeon Cetto. Conditional use request to build an 800 square foot accessory <br />structure in an R-9 (Single-Family Residential) zoning district. Property located at 275 Ball Park Road, <br />Casselberry, Florida. <br /> <br />Mr. Matt Dorsten, Planner, reviewed the information provided in his memorandum dated June 28, 2006, to the <br /> <br />City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development Department). Mr. <br /> <br />Dorsten said the conditional use application meets all of the criteria for granting the conditional use; therefore, City staff <br /> <br />supports the request. He said staff recommends approval of CU 06-13 to allow an 800 square foot accessory structure on <br /> <br />the property located at 275 Ball Park Road, Casselberry, Florida, based on the staff report dated June 28, 2006, the site <br /> <br />plan (Attachment A) dated December 8, 2004, and the conditions outlined in the staff report which were: <br />
