<br />Planning & Zoning Commission! <br />Local Planning Agency <br />July 12. 2006 <br />Page 2 <br /> <br />conclusions of the staff report dated June 29, 2006, the findings of fact of the Planning and Zoning Commission and the <br /> <br />conditions of approval outlined in the staff report which were: <br /> <br />1. The Planning and Zoning Commission approves the site modification request to allow the existing 4.5 foot <br />encroachment into the western side yard to allow a 3.0 side yard in lieu of the required 7.5 foot side yard. <br />2. The applicant shall contribute $12,750 to the City's Tree Bank Fund in accordance with Section 3-14.8 of the <br />ULDR. This amount shall be paid prior to the issuance of a building permit. <br />3. The following conditions shall be placed as a note on the cover page of the approved site plan: <br /> <br />a. The rear trailer storage area screening shall be continually maintained and screened to 90% opacity. <br /> <br />b. No vehicular sales, service, or leasing shall be conducted on the 1043 Seminola Boulevard property <br />without obtaining approval via conditional use. <br /> <br />4. The applicant shall satisfy all Public Works comments regarding the proposed site plan prior to a pre- <br />construction meeting. The developer and/or the general contractor shall have a pre-construction meeting with <br />the City's Public Works Department and resolve any outstanding site plan issues prior to the issuance of any <br />site engineering of construction permits by the City. <br />5. A right-of-way utilization permit from Seminole County shall be obtained prior to the issuance of a Certificate <br />of Completion by the City's Public Works Department. <br />6. Signage must conform to the City of Casselberry Unified Land Development Regulations, as well as, the <br />design criteria established in the various Seminole Boulevard Small Area Studies. <br />7. The site plan approval shall be valid for one year upon approval by the Planning and Zoning Commission. <br />An extension request must be submitted prior to the expiration. <br />8. All of the above conditions shall be fully and faithfully executed or the site plan shall become null and void. <br /> <br />Mr. Dorsten requested that the Planning and Zoning Commission amend the conditions of approval to add <br /> <br />condition number 9 requiring that the photometries comply with the Unified Land Development Regulations. <br /> <br />A discussion ensued regarding the driveway access and quantifying the 90% opacity screening required for the <br /> <br />rear trailer storage area. <br /> <br />In response to the Commission's question regarding vehicular sales, service or leasing, Mr. Dorsten stated that <br /> <br />condition 3b could be amended to also include 1059 Seminola Boulevard. The property owner's documents, deed <br /> <br />restrictions and easements documents were discussed. Mr. Dorsten stated that the Public Works Department would <br /> <br />require a copy of the St. John's River Water Management District's permit at the pre-construction meeting which is <br /> <br />addressed in the conditions of approval. <br /> <br />Mr. Kelley asked the applicant to come forward. Mr. Julian Coto, property owner and engineer, Seminola <br /> <br />Boulevard, Lot 6, Casselberry, Florida came forward. Mr. Coto stated that the maintenance of the stormwater and joint use <br /> <br />driveway are included in the Declaration of Easements and the easements for 1043 Seminola Boulevard have been <br /> <br />recorded. The Declaration of Easements for 1059 Seminola Boulevard has been submitted to the City. He said the <br />
