<br />Planning & Zoning Commission! <br />Local Planning Agency <br />June 28, 2006 <br />Page 6 of 14 <br /> <br />Mr. Mason submitted several case law documents and an article entitled "Weapon of Mass Destruction <br />Targets Sex Shop in Waldo" (copies are attached and made a part of the minutes). <br />Mr. Michael Pinter, 6150 Highway 17/92, Casselberry, Florida came forward. Mr. Pinter said he has been in <br /> <br />business in Casselberry for 43 years. He said he operates a good business and has never had any problems with <br />drugs or prostitution. Mr. Pinter explained he was not selling Club Juana by choice. He said the Florida Department <br /> <br />of Transportation approached him and said he had the option of voluntary condemnation or eminent domain for his <br /> <br />property. Mr. Pinter said he did not want to go through litigation with the Department of Transportation. Mr. Pinter <br /> <br />said that the Department of Transportation said he would be provided another acceptable location. He said that the <br />City said they have nothing to do with DOT and DOT said they have nothing to do with the City. Mr. Pinter said it is all <br /> <br />government and they are taking his livelihood and his property. <br /> <br />Mr. Pinter said he wants another viable location with traffic and visibility. Mr. Pinter said it has been proven in <br /> <br />Court that there are no adverse effects from adult entertainment businesses in Casselberry. He requested the <br /> <br />Commission be fair in finding a viable location on Highway 17/92 or State Road 436. <br /> <br />Mr. Mike Levine, Director of Operations for Pinter Enterprises, 6150 South US Highway 17/92, Casselberry, <br />Florida came forward. Mr. Levine said that the Pinter family has been operating a business at this location for 43 <br /> <br />years. Mr. Levine said location means everything. Mr. Levine felt the location option being discussed for Mr. Pinter's <br /> <br />business is inappropriate and punitive in nature. He said it is not fair to Mr. Pinter and his employees. Mr. Levine <br /> <br />requested the Planning and Zoning Commission consider the options that have been submitted for consideration. Mr. <br /> <br />Levine requested the Commission reconsider the options and make a fair and justifiable recommendation to the City <br /> <br />Commission for their approval. <br /> <br />Mr. Earl Ritchie, 1071 North Winter Park Drive, Casselberry, Florida came forward. Mr. Ritchie felt the City <br /> <br />was trying to hide the establishments and in doing so they are being put in their neighborhood. Mr. Ritchie said he is <br />opposed to adult entertainment in his neighborhood. He said the business should be located in a business district. <br />
