Ms. Reischmann explained that if the Commission <br /> <br />finds that any of the sites listed in the letter were acceptable sites it would require revising the zoning scheme and <br /> <br />changing the ordinances. Ms. Reischmann said she and Mr. Anthony Garganese, special counsel, are available to <br /> <br />answer any questions. <br /> <br />Ms. Smith stated the following changes are being made to the existing future land use designation I-M: <br /> <br />1. Change D: "Properties designated as Industrial-Medium shall not be directly visible by the <br />traveling public from a major arterial or colloctor roadway". <br />2. Change E: "Properties designated as Industrial-Medium shall not have frontage along a major <br />arterial or colloctor roadway" <br />3. Addition of H: "Properties designated Industrial-Medium shall be the only location for adult <br />entertainment establishments in the City". <br /> <br />Ms. Reischmann stated that each time adult entertainment establishment is referenced it should include a <br /> <br />reference to sexually-oriented businesses. <br /> <br />After a brief discussion, Mr. Kelley asked if there was anyone in the audience who wished to speak in favor <br /> <br />of, or in opposition to, the request. Ms. Diane Jackson, 811 Gee Creek Court, Casselberry, Florida came forward. <br /> <br />Ms. Jackson said she is concerned about a sexually-oriented business 500' from her home. Ms. Jackson fett a <br /> <br />sexually- oriented business would increase crime and drugs in her neighborhood. She was concerned for her safety. <br /> <br />Mr. Steve Mason, attorney, 1643 Hillcrest Street, Orlando, Florida came forward. Mr. Mason said he has <br /> <br />been representing Mr. Pinter for approximately 10 years. Mr. Mason stated that the City of Casselberry's Code is <br /> <br />operated under the dispersal theory and now it is being transformed to a congregation theory. He said this type of <br /> <br />zoning would congregate all the adult entertainment businesses into one small zone. <br />Mr. Mason said that Mr. Pinter appears to be a well respected and good neighbor of the community. Mr. <br /> <br />Mason said Mr. Pinter's business is a current existing use. He is a grandfathered non-conforming use in the City of <br /> <br />Casselberry. Mr. Mason requested the City amend this and allow Mr. Pinter to choose, with the City's approval, a site <br />in Casselberry where he can relocate Club Juana. Mr. Mason said that Mr. Pinter did not close Club Juana voluntarily. <br />Mr. Mason requested that the Planning and Zoning Commission consider giving Mr. Pinter a grandfathered site within <br />Casselberry outside the Industrial Medium zoning. <br />
