City Code, Section 14, must be revised to change the zoning location to 1M (Industrial Medium), repeal <br />prohibited locations, and amend non-conforming uses to grant status to existing non-conforming sites. <br /> <br />4. A small scale amendment is needed to amend the Future Land Use Map (FLUM) to designate the <br />appropriate properties as Industrial Medium. <br /> <br />5. The Official Zoning Map must be amended to designate the appropriate properties as 1M. <br /> <br />Ms. Smith explained that the City Commission has previously compiled a legislative record of data, case law <br /> <br />and studies regarding the adverse secondary effects of adult entertainment establishments and sexually-oriented <br /> <br />businesses with the enactment of Ordinance 99-934. Ms. Smith said the City Commission codified numerous <br /> <br />legislative findings into Chapter 14-67 of the Casselberry City Code. The data, case law and studies and the <br /> <br />legislative findings related to Ordinance No. 99-934 are being incorporated by reference to support the legislative acts <br /> <br />necessary to adopt the I-M future land use and zoning regulations relative to the adult entertainment establishments <br /> <br />and sexually-oriented businesses. Ms. Smith said, in addition, the 1999 legislative record is being supplemented with <br /> <br />additional data, case law and studies (4 volumes) regarding adverse secondary effects of adult entertainment <br /> <br />establishments and sexually-oriented businesses. <br /> <br />Ms. Katie Reischmann, City Attorney, said the additional studies, data and analysis regarding the secondary <br /> <br />effects of adult entertainment establishments are available in the City Clerk's office for review. <br /> <br />Ms. Reischmann explained that the City acquired the property known as the Northeast Industrial Park as part <br /> <br />of the Winter Park Drive extension; and the property has been platted and is ready for sale. Ms. Reischmann said the <br /> <br />City Commission is aware that this industrial area would be considered for potential adult entertainment sites. <br /> <br />Ms. Reischmann stated the purpose for tonight's meeting is to designate the future land use as industrial <br /> <br />medium and rezone the property; however at the same time asking the Commission to look at these sites as potential <br /> <br />adult entertainment sites. Ms. Reischmann said that the City has lost several of its existing adult entertainment <br /> <br />establishments. She said several years ago the City Commission and the Planning and Zoning Commission <br /> <br />attempted to find an additional location for adult entertainment establishments. <br /> <br />Ms. Reischmann distributed a letter dated June 16, 2006 to Mr. John Pavlis, Interim City Manager, that <br /> <br />discusses some potential sites that Mr. Pinter has requested as possible sites to relocate Club Juana (a copy of the <br />letter is attached and made a part of the minutes).
