<br />Planning & Zoning Commission! <br />Local Planning Agency <br />June 14, 2006 <br />Page 6 <br /> <br />Mr. Kelley asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, <br /> <br />the request. No one came forward. <br /> <br />Mr. Henson recommended approval CU 06-08 based on staff report dated June 9, 2006 to the Planning and <br /> <br />Zoning Commission from Mr. Matt Dorsten. Mr. Buchanan seconded the motion. The motion passed unanimously <br /> <br />by voice vote. <br /> <br />Seventh Item of Business: CU 06-09: Jose Perez's Domino Lounae. Conditional use request to operate a <br />lounge in the Lake Kathryn Plaza, 1205 South Highway 17/92, Casselberry, Florida. <br /> <br />Mr. Matt Dorsten, Planner, reviewed the information provided in his memorandum dated June 9, 2006, to <br /> <br />the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br />Department). Mr. Dorsten stated staff recommends approval of CU 06-09 to allow sales of beer and wine only for on- <br />site consumption at a Domino Lounge in the Lake Kathryn Plaza at 1205 Highway 17/92, Casselberry, Florida based <br /> <br />on the staff report dated June 9, 2006, the site plan dated June 6, 2006, and the conditions outlined in the staff report <br /> <br />which are: <br /> <br />1. The conditional use shall be limited to 1205 S HWY 17/92 only, as indicated on "Attachment A". <br />2. The site must meet City Code in all aspects prior to commencement of the conditional use. <br />3. Package sales of beer and/or wine is prohibited. Sales of alcohol shall be for beer and wine only <br />(2COP) and strictly for on site consumption. <br />4. There shall be no outside sales, storage, or display of goods, materials or services. <br />5. The property shall be maintained in accordance with Section 3-10.3 of the ULDR. <br />6. The domino game shall be for sport only and there shall be no charge to participate, nor prizes <br />provided to participants. Any other method of conducting the domino game would be considered <br />gambling. FS 849.085 prohibits "penny-ante games" unless conducted in a dwelling (residence) <br />and includes other restrictions. Gambling at this site is prohibited. <br />7. A distance variance shall be obtained from the City Commission prior to initiating the conditional <br />use. If the variance is not granted, the conditional use is null and void. <br />8. A new conditional use application shall be required if there is a change in ownership, if there is a <br />change in the name of the business, or if alcoholic beverage sales or use of the alcoholic beverage <br />license should cease for more than ninety (90) days. <br />9. The conditional use shall be implemented within ninety (90) days or the conditional use shall <br />become null and void. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become <br />null and void. <br />
