No one came forward. Mr. Henson recommended approval CU 06-08 based on staff report dated June 9, 2006 to the Planning and Zoning Commission from Mr. Matt Dorsten. Mr. Buchanan seconded the motion. The motion passed unanimously by voice vote. Seventh Item of Business: CU 06-09: Jose Perez's Domino Lounae. Conditional use request to operate a lounge in the Lake Kathryn Plaza, 1205 South Highway 17/92, Casselberry, Florida. Mr. Matt Dorsten, Planner, reviewed the information provided in his memorandum dated June 9, 2006, to the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development Department). Mr. Dorsten stated staff recommends approval of CU 06-09 to allow sales of beer and wine only for on- site consumption at a Domino Lounge in the Lake Kathryn Plaza at 1205 Highway 17/92, Casselberry, Florida based on the staff report dated June 9, 2006, the site plan dated June 6, 2006, and the conditions outlined in the staff report which are: 1. The conditional use shall be limited to 1205 S HWY 17/92 only, as indicated on "Attachment A". 2. The site must meet City Code in all aspects prior to commencement of the conditional use. 3. Package sales of beer and/or wine is prohibited. Sales of alcohol shall be for beer and wine only (2COP) and strictly for on site consumption. 4. There shall be no outside sales, storage, or display of goods, materials or services. 5. The property shall be maintained in accordance with Section 3-10.3 of the ULDR. 6. The domino game shall be for sport only and there shall be no charge to participate, nor prizes provided to participants. Any other method of conducting the domino game would be considered gambling. FS 849.085 prohibits "penny-ante games" unless conducted in a dwelling (residence) and includes other restrictions. Gambling at this site is prohibited. 7. A distance variance shall be obtained from the City Commission prior to initiating the conditional use. If the variance is not granted, the conditional use is null and void. 8. A new conditional use application shall be required if there is a change in ownership, if there is a change in the name of the business, or if alcoholic beverage sales or use of the alcoholic beverage license should cease for more than ninety (90) days. 9. The conditional use shall be implemented within ninety (90) days or the conditional use shall become null and void. 10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null and void.
