<br />Planning & Zoning Commission! <br />Local Planning Agency <br />June 14, 2006 <br />Page 5 <br /> <br />In response to the Commission's question, Ms. Smith said based on Mr. Stalowy's letter, staff could support <br />the request. <br /> <br />After a brief discussion, Mr. Kelley asked if there was anyone in the audience who wished to speak in favor <br /> <br />of, or in opposition to, the request. No one came forward. <br /> <br />Mr. Kelley asked for a motion to address SPR 06-13. Mr. Buchanan recommended denial of SPR 06-13 <br />Casselberry Commerce Village site plan modification request based on the staff report dated June 9, 2006. Mr. <br /> <br />Weinroth seconded the motion. The motion passed unanimously by voice vote. <br /> <br />Sixth Item of Business: CU 06-08: Richard & Laura Miller. Conditional use request to construct a dock at 172 <br />Norris Place, Casselberry, Florida. <br /> <br />Mr. Matt Dorsten, Planner, reviewed the information provided in his memorandum dated June 9, 2006, to <br /> <br />the City of Casselberry Planning and Zoning Commission (a copy is on file in the Community Development <br /> <br />Department). Mr. Dorsten said upon review of the conditional use request, the Planning and Zoning Commission's <br /> <br />approval of CU 06-08 for a private dock located on Lost Lake at 172 Norris Place, is based on the property plat dated <br /> <br />November 4, 1999, and the findings of fact and conclusions of the staff report dated June 9, 2006, and the conditions <br /> <br />outlined in the staff report which are: <br /> <br />1. The dock shall be built in accordance with the dimensions and specifications of the property survey <br />(Attachment B), the construction plan package (Attachment D) and as detailed in the staff report. <br />The dock shall not extend more than 58 feet into the lake. <br />2. The dock shall not be enlarged in any way. <br />3. The dock must be properly lighted between the hours of sunset and sunrise in accordance with <br />Section 94-6 of the City CODE and Section 3-1.3.6, Exterior Lighting of the Unified Land <br />Development Regulations. Lighting must be provided prior to the final inspection. <br />4. The construction and maintenance of the dock shall be in accordance with the requirements of all <br />applicable state agencies and the City's ULDR. <br />5. The Lost Lake HOA Architectural Review Committee shall provide a letter of approval to be <br />submitted with the building permit application. <br />6. A building permit for the dock shall be applied for within 60 days of the approval and a final <br />inspection shall be obtained within 180 days of the issuance of the building permit. <br />7. All of the above conditions shall be fully and faithfully executed or the conditional use shall become <br />null and void. <br />8. If the use is discontinued for a 6-month period, the conditional use shall become null and void. <br /> <br />Mr. Kelley asked the applicant to come forward. Mr. Richard Miller, 172 Norris Place, Casselberry, Florida <br /> <br />came forward. There were no questions for the applicant. <br />
