<br />Planning & Zoning Commission! <br />Local Planning Agency <br />March 22, 2006 <br />Page 2 <br /> <br />stated the Planning Division Staff recommends approval of LPA 06-01 and ZB 06-01 for the property located at 11 Lemon <br />Lane, Casselberry, Florida based on the staff report dated February 3, 2006, the Voluntary Development Commitment, and <br /> <br />the following findings of fact: <br /> <br />1. The Voluntary Development Commitment ensures the development of the site will conform to the City's CRA master <br />plan, CRA design standards, and other City regulations. <br />2. The future land use and zoning designations are consistent with the City's Comprehensive Plan. <br />3. The future land use and zoning designations are compatible with the surrounding mix of zonings and land uses. <br />4. The future land use and zoning designations will improve the economic redevelopment of the area and will increase <br />property values. <br /> <br />A discussion ensued regarding Voluntary Development Commitment #06-01. In response to the Commission's <br /> <br />question, Mr. Dorsten stated that a condition could be added that the property owner must combine the subject property prior <br /> <br />to site plan approval. A correction was made to 3.b.ii to change "eastern" to "western". <br />The access and landscaping along Lemon Lane was discussed. The Commission approved one curb cut on Lemon <br /> <br />Lane according to standard engineering practices and a hedge would be planted adjacent to the Lemon Lane right-of-way. <br />Mr. Kelley asked the applicant to come forward. Mr. Khaled Akkawi, 2221 Lakeside Drive, Orlando, Florida came <br /> <br />forward. The Commission had no questions for the applicant. <br />Mr. Kelley asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br /> <br />request. Mr. Ed Cerni, 261 Fern Street, Casselberry, Florida came forward to speak in opposition to the request. Mr. Cerni <br /> <br />said a commercial use is intrusive to a residential neighborhood. He also expressed a concern with noise issues. <br /> <br />Ms. Lynell Mulcahy, 111 South Sunset Drive, Casselberry, Florida came forward to speak in opposition to the <br />request. Ms. Mulcahy stated she owns property in the area. Ms. Mulcahy was concerned with the parking on Lemon Lane. <br />Ms. Mulcahy felt that the change in parking was being done to accommodate enlarging the building. <br />Mr. Andy Gaba, 111 Lemon Lane, Casselberry, Florida came forward to speak in opposition to the request. Mr. <br />Gaba was concerned with property values in the area. He didn't feel the site was compatible with the area. Mr. Gaba also <br /> <br />expressed a concern with the occupancy capacity for the building. <br />Mr. John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. Casselberry was <br /> <br />concerned with changing the future land use designation and zoning before submittal of a site plan. <br />
