The applicant will submit a check payable to Seminole County, prior to the recording of <br />the final replat. <br /> <br />Staff Recommendation: Approval of Legacy Park Phase II Replat with the conditions as <br />presented. <br /> <br />Audience Input: <br /> <br />I) John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida, encouraged the <br />Commission to pay close attention to the public records regarding Centex. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Susan Doerner to approve SP 07-07, <br />Legacy Park Phase III Replat, with conditions as stipulated. Motion <br />was seconded by Vice Mayor/Commissioner Colleen S. Hufford and <br />carried unanimously on a 5 - 0 voice vote. <br /> <br />13. Discussion Items: <br /> <br />A. Street Lighting Assessment Fees <br /> <br />Staff Presentations bv Robert Sheets, GSG. Public Works Director. Ed Torres. and Phvllis <br />Wallace. Special Projects: (A copy of the power point presentation presented by staff are attached <br />to and made a part of these minutes.) <br /> <br />The Street Lighting Assessment Program is presented to assist in development and implementing a <br />non ad-valorem spccial assessment to fund ongoing operating and maintenance costs of street <br />lighting. The two specific geographic areas in the City are the commercial service area along U.S. <br />17/92, S.R. 436 and S.R. 434 and non-commercial area in subdivisions; private subdivisions that pay <br />for their service with contractual agreements with Progress Energy are exceptions. Street light fees <br />are currently paid out of the Local Option Gas Tax (LOGT) fund. Staff outlined two scenarios <br />regarding the budgetary implementation of the assessment as follows: <br /> <br />(I) Commercial Corridor - full cost budget include City departmental, administrative <br />costs at $36.50 per unit/per year; and, <br /> <br />Non Commercial (Residential) Corridor at $37.60 per unit/per year. <br /> <br />(2) Commercial Corridor - only includes the Progress Energy costs - light fixture and <br />pole rental, maintenance, and fuel energy and collection at 100% at a cost of$25.80 <br />. per unit/per year. Commercial corridors receive yearly revenues from FDOT; and <br /> <br />Non Commercial (Residential) Corridor - only includes the Progress Energy costs- <br />light fixture and pole rental, maintenance, and fuel-energy and collection costs at <br />100% at a cost of $3 1 .40 per unit/per year. <br /> <br />Staff Recommendation: Proceed with the implementation of Scenario Number2, Residential at <br />$31.40 per unit per year and Commercial at $25.80 per ERU/per year. Staff also recommended no <br />exemptions, which is consistent with other fees. <br />
