<br />Board of Adjustment <br />February 28, 2008 <br />Page 2 <br /> <br />access to the easement is needed it would require removal of the fence. <br /> <br />Mr. Senzee said since the preparation of the staff report, he has had several discussions with representatives <br /> <br />from the Lost Lake Estates Homeowners' Association. He said the representatives were not in favor of the variance. Mr. <br /> <br />Senzee said the applicant was notified regarding the Homeowners' Associations' concerns. Mr. Senzee distributed and <br /> <br />reviewed a letter from the Lost Lake Estates Homeowners' Association dated February 26, 2008 to the Board of <br /> <br />Adjustment (a copy of the letter is attached and made a part of the minutes). <br /> <br />Mr. Senzee said the variance application meets 5 of the 6 criteria for granting the variance; therefore, City staff <br /> <br />cannot fully support the request. He said if the Board of Adjustment chooses to grant the variance requested for BA 08- <br /> <br />01, for the property located at 831 Moonlit Lane, to allow a 6 foot tall fence forward of the front building line, the motion <br /> <br />should be based upon the Board of Adjustment's findings of fact and conclusions, the property site plan (Exhibit B of the <br /> <br />staff report), and the conditions outlined in the staff report which were: <br /> <br />1. The variance shall only pertain to the proposed fence shown in Exhibit B. <br />2. The fence shall match the vinyl material used for the adjacent fence to the west. <br />3. The fence may not be located in the existing landscape easement. <br />4. The applicant shall install hedge materials along Moonlit Lane which shall serve to screen the fence <br />from the roadway. These materials shall match the materials used on the neighboring properties to <br />the west. These materials shall be inspected and approved by City staff after installation. <br />5. The applicant shall seek separate approval from the Lost Lake Estates Homeowners Association prior <br />to cQnstruction of the proposed fence. <br />6. The ff'nc~ shall meet all other site development criteria. <br />7. A building permit for the fence shall be obtained from the City's Building Safety Bureau within 60 <br />days of the approval by the Board of Adjustment and the certificate of completion shall be obtained <br />with 120 days of the issuance of the building permit. <br />8. All of the above conditions shall be fully and faithfully executed or the variance shall become null and <br />void. <br /> <br />After a brief discussion, Mr. Bowman asked the applicant to come forward. Mr. Michael Savino, 831 Moonlit <br /> <br />Lane, Casselberry, Florida came forward. Mr. Savino said there was some confusion with the HOA approval letter. He <br /> <br />explained that he received an approval letter from the Homeowners' Association in 2000 and he wasn't aware that he <br /> <br />needed a new approval letter from the HOA. Mr. Savino said he would reapply with the HOA for approval. <br /> <br />Mr. Savino said the lot shape is unique and the backyard is very small. He said a fence was installed in 2000 to <br /> <br />separate the rear yards. He said that portion of the fence did not require a variance. Mr. Savino distributed a photograph <br /> <br />to the Board depicting the proposed fence and hedges (a copy of the photograph is attached and made a part of the <br />
