Mr. Savino said the fence would provide an area for his dog and also additional privacy due to the large <br /> <br />window located on that side of the house. <br /> <br />Mr. Savino said there are similar properties in the subdivision that have installed fences. Mr. Savino felt that the <br /> <br />addition of the fence and hedges to the existing fenced area would provide a more uniform look to the neighborhood. <br /> <br />Mr. Savino submitted a signed document dated February 26, 2008 from three of the adjacent neighbors in favor <br /> <br />of the variance request (a copy of the letter is attached and made a part ofthe minutes). He said two houses across from <br /> <br />his home are vacant at this time; therefore, he was unable to acquire signatures for those properties. <br /> <br />Mr. Senzee stated the City most likely required the developer to plant the hedges to provide a rear yard for the <br /> <br />through lots. He explained that a management firm representing the developer manages the HOA during the <br /> <br />development of the property. He said the management of the HOA is later turned over to the residents and this may have <br /> <br />caused the confusion regarding the HOA approval letter. <br /> <br />Mr. Bowman asked if there was anyone in the audience who wished to speak in favor of the request. Mr. <br /> <br />Stephen Ferguson, President of the Homeowners' Association, 838 Moonlit Lane, Casselberry, Florida came forward. <br /> <br />Mr. Ferguson felt that the 2000 HOA letter was void. He said the letter was issued by the developer and not the current <br /> <br />HOA. He said they are not in disagreement with the variance; however, Mr. Savino is required to reapply to the HOA for <br /> <br />the fence approval. <br /> <br />In response to the Board's question, Mr. Ferguson, said he would approve the fence request based on what has <br /> <br />been presented at tonight's meeting. <br /> <br />Mr. Bowman asked if there was anyone in the audience who wished to speak in opposition to the request. Mr. <br /> <br />John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida came forward. Mr. Casselberry questioned possible <br /> <br />fence locations, structure setbacks for a corner lot and the code requirements for fencing and building setbacks. <br /> <br />After a brief discussion, Mr. Bowman asked for a motion for BA 08-01. Mr. Guzman made a motion to approve <br /> <br />BA 08-01 based on findings no. 1,2,3,4 and 6 of the staff report, the addition of finding no. 5 that the variance granted is <br /> <br />the minimum variance needed to make use of the applicant's land and any less variance allowed would be an <br /> <br />unreasonable use of the applicant's land, adopting the staff recommendations and amending condition no. 5 that the <br />
