:ITY OF CASSELBERRY
CODE ENFORCEMENT BOARD MEETING
JUNE 12, 2008 PAGE 3

CEO Lawrence stated that Mr. Thomley had submitted an application for demolition, however there is no contract
between Mr. Thomley and Mr. Rubin to complete that job. She thcn stated that Hank Lander was also in the audience,
and would be speaking for Mr. Rubin. Another representative was in the audience, Ken Wagner, whom CEO Lawrence
has been communicating with. CEO Lawrence stated that complaints have been received for the past three years on this
propeliy. Mr. Rubin each time has minimally taken action to keep the property standing.

CEO Lawrence stated the City is asking for no more than thiliy days for Mr. Rubin to make a decision and to submit a
contract to the City for either removal of the structure, demolition of the structure or restoration of the structure.

Richard L. Henderson asked CEO Lawrence ifthcy had received a penllit.

CEO Lawrence stated no, they had applied for it. The pennit could be approved, should Mr. Rubin decide that is the
action that he wants to take, he has not made a decision on how he wants to act on the propeliy yet.

Debra Babb-Nutcher asked CEO Lawrence, thc City is asking for thiliy days tor them to just makc a decision or to comc
into compliance.

CEO Lawrence stated to submit the contract, and ifit is demolished they could come into compliance in thiliy days. She
thcn statcd the application is already in process, a contract would need to be signed and within a period of about thirty
days the structure could be demolished.

Ms. Babb-Nutcher asked what if they choose to make repairs.

CEO Lawrencc stated if they choose to make repairs it \vould be contingent on the building pemlit and the site plan that
is submitted to the Building Depmimcnt, it could be six months could be a year. This would depend on the type of
renovations that might be applicd for. If they dccide to remove the structure and transport it to a different location, Ms.
Lawrence could not answer how long that would take, and that Mr. Lander may be able to evaluate that.

Ms. Babb-Nutcher stated that making a decision is not coming into compliance that would be up to the Board to
detennine that.

Mr. Henderson stated the City is asking the Board to put pressure on them, to present the City with a contract within the
next thirty days. Mr. Henderson stated that it seemed to him that this could be worked out between the City and them
over the next thiliy days. If they do not present a contract within that thiliy days then bring it to the Board.

CEO Lawrence stated they have not submitted it, that is what they have been working to try to get done, and that has not
becn submitted as of 06112/2008.

Mr. Henderson asked how long have they been trying to get this done.

CEO Lawrence stated she has been working on this case since 03/31/2008. Since 03/31/2008 Mr. Rubin has discussed
with CEO Lawrence many times that it is his intent to demolish the building. So far an application has been submitted
but as he has not signed a contract with the contractor that submitted the application, it is simply an application sitting in
file until it is paid for.

Discussion.

Phillip Weekley asked CEO Lawrcnce ifthe goal is to have Mr. Rubin sign a contract for demolition.
