<br />Planning & Zoning Commission! <br />Local Planning Agency <br />July 9, 2008 <br />Page 2 <br /> <br />exceeds the allowed height requirements for an accessory structure. Staff is deeply concerned that misuse and/or <br /> <br />construction delays on the future home could create irreversible and unenforceable situations on the subject <br /> <br />property. Enforcement of potential conditions of approval could prove difficult. For these reasons staff is unable to <br /> <br />support the conditional use request and recommends that the proposed garage be constructed simultaneously with <br /> <br />the future home. Mr. Senzee said if the Planning and Zoning Commission chooses to approve CU 08-06 to allow a <br /> <br />two story 1,428 square foot accessory structure on the property located at 83 North Winter Park Drive, the motion <br /> <br />shall be based on the staff report dated July 2, 2008, the site plan attached to the staff report, the Planning and <br /> <br />Zoning Commission's findings of fact, and the conditions outlined in the staff report which were: <br /> <br />1. The detached accessory structure shall meet the required side and rear yard requirements and be <br />located at least ten feet from the northern property line and a minimum of 50 feet from the wetlands <br />line, in the approximate location as depicted on the property survey shown as Exhibit D attached to the <br />staff report. <br />2. The detached accessory structure shall not exceed 1,428 square feet in size and shall not exceed 25 <br />feet in overall height. <br />3. No hazardous materials shall be used, stored or generated at the site. <br />4. The detached accessory structure shall not be used for any commercial or business activities. <br />5. The detached accessory structure shall not be used for any residential activities; there shall be no <br />kitchen facilities within the detached accessory structure. <br />6. All existing accessory structures on the property shall be removed prior to final inspection and issuance <br />of a certificate of occupancy for the subject detached accessory structure. <br />l. All debris and materials located at the rear of the property shall be placed within the subject structure or <br />removed from the property prior to issuance of a certificate of occupancy. <br />8. All non-functional vehicles located at the rear of the property shall be placed within the subject structure <br />or removed from the property immediately upon issuance of a certificate of occupancy. <br />9. A building permit shall be obtained from the City within three months and construction shall be <br />completed within one year of the date of the approval. <br />10. All of the above conditions shall be fully and faithfully executed or the conditional use shall become null <br />and void. <br /> <br />After brief discussion regarding the additional square footage of the loft area of the accessory structure, Mr. <br /> <br />Buchanan asked the applicant to come forward. Mr. Michael Kolar, 212 Carriage Hill, Casselberry, Florida came <br /> <br />forward. In response to the Board's question regarding the delay in the construction of the 2004 conditional use <br /> <br />approval, Mr. Kolar said he relocated to Florida to complete his education and he was not sure if he would remain in <br /> <br />Florida after graduation. <br /> <br />In response to the Board's questions, Mr. Kolar said that he would live in the existing house on Winter Park <br /> <br />Drive until he is financially able to build the house. He said at this time he needs the garage to store his collection of <br />
