Mr. Larry Powalisz, 4583 Whimbrel Place, Winter Park, <br /> <br />Florida came forward. In response to the Commission's question Mr. Wallace said he read the staff report and he <br /> <br />understands the conditions of approval. <br /> <br />Mr. Buchanan asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br /> <br />request. No one came forward. <br /> <br />Mr. Buchanan asked for a motion to address SPR 08-13. Mr. Henson recommended approval of SPR 08-13 <br /> <br />based on the staff report dated August 8, 2008 to the Planning and Zoning Commission from Mr. Senzee with the deletion <br /> <br />of condition number 4 from the staff recommendations. Mr. Van Meter seconded the motion. <br /> <br />The Board was polled. <br /> <br />David Henson Yes <br />Michael Buchanan Yes <br />Harley Parkhurst Yes <br />Stanley Weinroth Yes <br />Anthony Aramendia Yes <br />Nathan Van Meter Yes <br />Daniel Hale Yes <br /> <br />The motion passed unanimously. <br /> <br />Sixth Item of Business: LPA 07-13 Eminent Domain: ULDR Amendment to add criteria for eminent domain for <br />acquisitions for public use. <br /> <br />Ms. Sandra Smith, Chief Planner, explained that LPA 07-13 is an amendment to the Unified Land Development <br /> <br />Regulations (ULDR) to include language regarding takings and non conformities on properties that are taken during some <br /> <br />type of jurisdiction/governmental project. She said the City Code currently has language regarding residential properties; <br /> <br />however, there is nothing for commercial properties. This ordinance was to provide a unified code to address both <br /> <br />residential and commercial properties. Ms. Smith said at this time the City Manager has requested the Planning and <br /> <br />Zoning Commission continue this item to provide staff an opportunity to conduct additional research regarding the <br /> <br />practices of other jurisdictions. Ms. Smith requested the Commission continue this item to the next Planning and Zoning <br /> <br />Commission meeting. <br />
