Ms. Smith said this item carne about during discussions with Florida Department of <br /> <br />Transportation (FDOT) regarding the US 17-92 flyover project. The Florida Department of Transportation sent the <br /> <br />Community Development Department a letter requesting information on the lot size requirements for determination of non- <br /> <br />conforming sites. She said Code requires 20,000 square feet of area for a commercial site. She said the Public Works <br /> <br />Department informed her that FDOT was concerned that the City considered anything less than 20,000 square feet as <br /> <br />substandard non-conforming. She said based on that information, FDOT provided the Public Works Department an <br /> <br />ordinance that has been utilized with Orange County, Orlando and Osceola County to conduct some of their road projects. <br /> <br />Ms. Smith said staff is concerned from a planning perspective. She said the ordinance speaks to the fact that the <br /> <br />Administrative Official has the ability to grant waivers and variances and Mr. Paradise, as the Administrative Official, felt <br /> <br />uncomfortable being placed in that position. Ms. Smith said a policy is needed to consider lot size, required parking, <br /> <br />landscaping strips etc. A brief discussion ensued regarding the City providing controls that would protect the City. Ms. <br /> <br />Smith said she has contacted the adjacent jurisdictions regarding eminent domain. The City of Sanford responded that it <br /> <br />is not addressed in their Code. The City of Oviedo was approached by FDOT with the same ordinance; however, there is <br /> <br />language in their Code that addresses this issue. <br /> <br />A discussion ensued regarding remainder pieces of land being used as green space. She said this ordinance will <br /> <br />allow FDOT and the City of Casselberry to provide concessions to property owners with public acquisition of land. <br /> <br />Mr. Buchanan asked if there was anyone in the audience who wished to speak in favor of, or in opposition to, the <br /> <br />request. No carne forward. <br /> <br />Mr. Buchanan asked for a motion to address LPA 07-13. Mr. Henson made a motion to table LPA 07-13 to the <br /> <br />call of the Chair.
