<br />revised May 9,1996 <br /> <br />AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF CASSELBERRY <br />AND THE SCHOOL BOARD OF SEMINOLE COUNTY REGARDING AN <br />EXCHANGE OF LAND AT SOUTH SEMINOLE MIDDLE SCHOOL <br /> <br />This INTERLOCAL AGREEMENT is made and entered into this _ day of <br />, 1996, by and between the SCHOOL BOARD OF SEMINOLE <br />COUNTY, FLORIDA, the governing body of the Seminole County School District <br />pursuant to State law, hereinafter referred to as the" BOARD", whose address is 400 <br />East Lake Mary Boulevard, Sanford, Florida, 32773, and THE CITY OF <br />CASSELBERRY, a political subdivision of the State of Florida, hereinafter referred to as <br />the "CITY", whose address is 95 Triplet Lake Drive, Casselberry, Florida 32707, <br />regarding an exchange ofland at South Seminole Middle School. <br /> <br />WHEREAS, the BOARD owns environmentally sensitive land that cannot be <br />developed to augment the educational facility at South Seminole Middle School because <br />oflocation and environmental restrictions, and <br /> <br />WHEREAS, the CITY has a need for additional passive recreation areas, and <br /> <br />WHEREAS, the CITY owns land area at the entrance of South Seminole Middle <br />School that is currently vacant, and <br /> <br />WHEREAS, the BOARD requires additional land to construct a school entrance <br />drive that meets traffic engineering standards, and <br /> <br />WHEREAS, the terms and conditions of this agreement are consistent with the <br />City of Casselberry Comprehensive Plan and serve a public need, and <br /> <br />WHEREAS, the BOARD's land and the CITY's land are of comparable value <br />and an exchange will provide mutual benefit, and <br /> <br />WHEREAS, each land parcel will remain in public use, and <br /> <br />WHEREAS, the BOARD and the CITY have previously executed an interlocal <br />agreement to provide for mutual use of facilities, and <br /> <br />WHEREAS, this interlocal agreement is authorized pursuant to the provisions of <br />Chapters 125 and 163 Florida Statutes, as well as other applicable law, <br /> <br />NOW THEREFORE, in consideration of the mutual understandings, promises, <br />agreements, and covenants set forth herein, and other good and valuable consideration, <br />the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: <br />
