Second Reading of Ordinance 08-1237 - Amend ULDR Section 3-4.6, Signs Electronic <br />Message Boards (LP A 7-06) <br /> <br />The Deputy City Clerk read Ordinance 08-1237 by title as follows: <br /> <br />"AN ORDINANCE AMENDING CERTAIN PROVISIONS OF ARTICLE XVI OF THE <br />CITY OF CASSELBERRY UNIFIED LAND DEVELOPMENT REGULATIONS <br />RELATING TO SIGNS; AMENDING SECTION 3-16.2, DEFINITIONS, TO REVISE <br />DEFINITION OF ANIMATED SIGNS AND TO ADD A DEFINITION FOR <br />ELECTRONIC DISPLAY TYPE SIGNS; AMENDING SECTION 3-16.8, PROHIBITED <br />SIGNS, TO PROHIBIT SIGNS WITH DISTRACTING LIGHTING; AMENDING 3-16.9 <br />TO CLARIFY PROHIBITION ON INCREASES IN NON-CONFORMING SIGNS, AND <br />TO PROVIDE AN AMORTIZATION SCHEDULE; REPEALING SECTIONS 3.16.7(D) <br />AND 3-16.10(G), AND RENUMBERING 3-16.7(E); ADDING SECTION 3-16.13, <br />APPEALS TO BOARD OF ADJUSTMENT; SECTION 3-16.14, APPELLATE <br />DECISIONS DEEMED FINAL SUBJECT TO REVIEW; SECTION 3-16.15, <br />SUBSTITUTION OF NON-COMMERCIAL SPEECH FOR COMMERCIAL SPEECH; <br />SECTION 3-16.16, CONTENT NEUTRALITY AS TO SIGN MESSAGE; 3-16.17, <br />PROVIDING FOR SEVERABILITY, CODIFICATION, CONFLICTS AND EFFECTIVE <br />DATE." <br /> <br />Lel!al Advertisement: Advertised in the Orlando Sentinel on Thursday, March 13, 2008. <br /> <br />Staff Presentation bv Sandra Smith, Chief Planner: The first reading of Ordinance 08-1247 <br />was approved by the City Commission on March 10,2008. Ordinance 08- I 237, being presented <br />for second reading, amends sections of Article XVI, Signs, within the Unified Land <br />Development Regulations (ULDR) to address animated signs, electronic signs, non-conforming <br />signs, content neutral speech, provides an appeal process and defines severability. The City <br />Commission imposed a six-month moratorium on the issuance of building perrnits for electronic <br />type signs at their meting of November 13, 2007; moratorium will expire May 13,2008. <br /> <br />Based upon input from the Commission at the March 10, 2008 Meeting, staff recommends the <br />following: <br /> <br />. Prohibition of "electronic display type signs" , animated signs that including <br />flashing or moving signs, mult~vision signs and signs that digitally or <br />electronically produce color and/or black and white images similar to a television <br />screen. <br />. Changeable copy signs that are changed manually are allowed. <br />. Non-conforming signs can be maintained until march 1,2020. The value of a <br />sign will be determined by an appraiser experienced with sign values. <br />· Appeals - Eliminates sections of the Code that addresses non-conforming signs <br />and permit denials. Provides a new section for addressing appeals. Deems <br />Appellate decisions as final, subject to Circuit Court judicial appeal. <br />. Severability - The City Attorney has provided significant language to ensure <br />that, should a legal challenge prevail regarding a particular portion of Article <br />XVI, the remainder of the sign requirements will remain in tact. <br />
