<br />City Commission Meeting <br />March 10, 2008 <br />Page 4 <br /> <br />Le!!al Advertisement: Advertised in the Orlando Sentinel on March 2, 2008. <br /> <br />Staff Presentation, Sandra Smith, Chief Planner: Ordinance 08-1237 amends sections of <br />Article XVI, Signs, within the Unified Land Development Regulations (ULDR) to address <br />animated signs and electronic signs within the City. This ordinance was initiated due to the <br />proliferation of electronic billboards near the City and the issuance of several building permits for <br />electronic signs within the City. On November 13,2007, the City Commission passed a six- <br />month moratorium on the issuance of such signs which will expire on May 13,2008. (Power <br />point presentation attached to and made a part of these Minutes.) <br /> <br />Ordinance 08-1237 contains the following: <br /> <br />. Prohibits the use of animated and electronic signs within the City, allows manually <br />changeable copy signs <br />. Justification to support the amendments to the sign criteria <br />. Non-conforming signs that are affected by the new requirements may remain until <br />March 2020, at which time the sign will be brought into conformance <br />. An appeal process to the Board of Adjustment is provided based on errors/actions of the <br />Administrative Official <br />. Content Neutral Speech - No limitations shall be placed on a sign based upon the <br />content of the message <br />. Severability - Significant language has been provided by the City Attorney regarding <br />legal challenges <br /> <br />Staff Recommendation: Approve Ordinance 08-1237 and schedule the second reading and final <br />public hearing for March 24, 2008. <br /> <br />Audience InDut: <br /> <br />I) John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida, opined that electronic <br />signs are a part of high technology and suggested more regulations could be imposed on these <br />type signs rather than total prohibition. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Susan Doerner to approve Ordinance 08- <br />1237, Amending ULDR Section re Signs, Electronic Message Boards, <br />as presented. Motion was seconded by Commissioner Sandra T. <br />Solomon and carried on a 4 - 1 voice vote. <br /> <br />Mayor Bob Goff dissenting. He indicated that he supported the <br />ordinance insofar as animatedlflashing distraction signs, but was <br />voting against the ordinance strictly on the electronic aspect which <br />he supported the bnsiness community being allowed to change their <br />message every twenty-fonr honrs. <br />
