Staff Presentation, Sandra Smith, Chief Planner: Ordinance 08-1237 amends sections of Article XVI, Signs, within the Unified Land Development Regulations (ULDR) to address animated signs and electronic signs within the City. This ordinance was initiated due to the proliferation of electronic billboards near the City and the issuance of several building permits for electronic signs within the City. On November 13,2007, the City Commission passed a six- month moratorium on the issuance of such signs which will expire on May 13,2008. (Power point presentation attached to and made a part of these Minutes.) Ordinance 08-1237 contains the following: . Prohibits the use of animated and electronic signs within the City, allows manually changeable copy signs . Justification to support the amendments to the sign criteria . Non-conforming signs that are affected by the new requirements may remain until March 2020, at which time the sign will be brought into conformance . An appeal process to the Board of Adjustment is provided based on errors/actions of the Administrative Official . Content Neutral Speech - No limitations shall be placed on a sign based upon the content of the message . Severability - Significant language has been provided by the City Attorney regarding legal challenges Staff Recommendation: Approve Ordinance 08-1237 and schedule the second reading and final public hearing for March 24, 2008. Audience InDut: I) John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida, opined that electronic signs are a part of high technology and suggested more regulations could be imposed on these type signs rather than total prohibition. MOTION: Moved by Commissioner Susan Doerner to approve Ordinance 08- 1237, Amending ULDR Section re Signs, Electronic Message Boards, as presented. Motion was seconded by Commissioner Sandra T. Solomon and carried on a 4 - 1 voice vote. Mayor Bob Goff dissenting. He indicated that he supported the ordinance insofar as animatedlflashing distraction signs, but was voting against the ordinance strictly on the electronic aspect which he supported the bnsiness community being allowed to change their message every twenty-fonr honrs.
