Motion was seconded by Commissioner Jon Miller and carried nnanimously on a 5 - 0 voice vote. C. First Reading of Ordinance 08-1234 - Public School Facilities Element The City Clerk read Ordinance 08-1234 by title as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF CASSELBERRY COMPREHENSIVE PLAN PURSUANT TO FLORIDA STATUTES, CHAPTER 163; PROVIDING FOR ADOPTION OF A TEXT AMENDMENT PROVIDING THE PUBLIC SCHOOL FACILITIES ELEMENT; PROVIDING FOR CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE." Le!!al Advertisement: Advertised in the Orlando Sentinel on December 27, 2007. Staff Presentation: Ordinance 08-1234 will adopt the Public School Facilities Element that was submitted to the Department ofCommllnity Affairs as part of the Large Scale Amendment Package that was approved by the City Commission on December 10,2007. Legislation requires that each local government enter into an Interlocal Agreement to establish the process and mitigation used to achieve school concurrency. The Department of Community Affairs determined that the Countywide ]nterlocal Agreement was not compliant. Ordinance 08-1234 incorporates changes made by the City in response to comments by the Department of Community Affairs. Staff Recommendation: The staff and City Attorney recommend approval of Ordinance 08- 1234 on first reading and schedule second reading and public hearing for January 28, 2008. Motion was seconded by Commissioner Snsan Doerner and carried unanimously on a 5 - 0 voice vote. Pnrsuant to Resolution 06-1703, the City Commission voted at 9:30 p.m., to continne the meeting without any modification.
