Second Reading of Ordinance 07-1218 - Amendment to the City Charter - City <br />Commission Composition <br /> <br />The City Clerk read Ordinance 07-1218 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, SUBMITTING TO <br />THE ELECTORS OF CASSELBERRY PROPOSED AMENDMENTS TO THE <br />CHARTER OF THE CITY OF CASSELBERRY AT A SPECIAL ELECTION TO BE <br />HELD JANUARY 29, 2008; PROVIDING FOR REVISIONS TO ARTICLE IV, SECTION <br />10, CREATION OF CITY COMMISSION; COMPOSITION; TERM; ARTICLE IV, <br />SECTION 12, MAYOR; VICE MAYOR; TO CREATE A COMMISSION ELECTED <br />MAYOR; PROVIDING BALLOT TITLES, SUMMARIES AND TEXT FOR THE <br />PROPOSED AMENDMENTS; PROVIDING FOR THE CALL OF A REFERENDUM <br />ELECTION; PROVIDING FOR DIRECTION TO THE CITY CLERK; PROVIDING <br />FOR CONFLICTS, SEVERABILITY; PROVIDING FOR EFFECTIVE DATE FOR <br />APPROVED AMENDMENTS; PROVIDING CONFLICTS, SEVERABILITY, AND AN <br />EFFECTIVE DATE FOR THE ORDINANCE." <br /> <br />Lel!al Advertisement: Advertised in the Orlando Sentinel on August 2, 2007. <br /> <br />Staff Presentation: Ordinance 07-12 18 was approved on first reading by the Commission on <br />July 23, 2007. This ordinance approves the third amendment to the Charter, which authorizes the <br />City Commission to annually elect a Mayor from among the members ofthe Commission. The <br />three Charter referendum questions to be placed on the ballot at the January 29, 2008 election will <br />be as follows: <br /> <br />. Charter Amendment 1 - City Manager's Authority Regarding Hiring/Firing of <br />Administrative Personnel <br />. Charter Amendment 2 - Change of Election Date and Requiring a Majority Vote/Runoff <br />Elections <br />. Charter Amendment 3 - Annually Election Mayor by the City Commission from its <br />Members <br /> <br />StaITRecommendation: Approval of Ordinance 07-1218 on second reading and forward to the <br />Supervisor of Elections for incorporation on the January 29, 2008 ballot. <br /> <br />Audience Input: <br /> <br />1) John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida, suggested that the <br />City Commission consider the adult entertainment issue as an item for the referendum. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Jon Miller to approve Ordinance 07-1218, <br />adding Charter Amendment #3 to the January 29, 2008 ballot. <br />Motion was seconded by Vice Mayor/Commissioner Susan Doerner <br />and carried on a 4 - 1 voice vote. Mayor Bob Goff dissenting. <br />
