<br />City Commission Meeting <br />August 13, 2007 <br />Page 5 <br /> <br />StaITPresentation: Ordinance 07-1216 was approved on first reading July 9, 2007 initiated due <br />to complaints from citizens because of dry conditions, air pollution and endangerment to citizens <br />and property. The ordinance amends Chapter 42, Section 42-2, Open Burning and prohibits all <br />open buming within the City, except for fire training or prescribed burns conducted by the Fire <br />Department or the State Division of Forestry. Fire Marshal, Tim Ippolito, stated that the fines for <br />open burning violations would be increased from $50.00 to $300.00, which will be addressed in <br />Ordinance 07-1219 later on the agenda.. <br /> <br />Staff Recommendation: Approval of Ordinance 07-1216 as presented. <br /> <br />Audience Input: <br /> <br />I) Sam Hart, 161 South Triplet Lake Drive, Casselberry, Florida, spoke in opposition to <br />Ordinance 07-1216, opining that the Commission should not enact legislation generated by <br />complaints of one City Commissioner. He stated that Commissioner Doerner made several <br />complaints regarding his fire pit and the Fire Department indicated that he was in compliance <br />regarding each complaint. <br /> <br />2) Lisa Hart, 161 South Triplet Lake Drive, Casselberry, Florida, spoke in opposition to <br />Ordinance 07-1216. She submitted pictures that indicated her fire pit to be in compliance with <br />the law. She stated that she had contacted her attorney regarding the continual, personal <br />harassment by Commissioner Doerner regarding this issue. <br /> <br />3) Anthony Armenda, 1080 Crystal Bowl Circle, Casselberry, Florida, spoke in support of <br />Ordinance 07-1216, stating that the Hart's fire pit had caught two trees on fire and that ordinances <br />are enacted for the protection of all citizens. <br /> <br />4) Craig Tull, 420 Ranch Trail, Casselberry, Florida, stated that the Commission should <br />enact laws for the benefit of all citizens and not for self-centered purposes. <br /> <br />MOTION: <br /> <br />Moved by Commissioner Colleen S. Hufford to approve Ordinance <br />07-1216, Amendment to Chapter 42, Open Burning, as presented. <br />Motion was seconded by Commissioner Sandra T. Solomon. <br /> <br />Commissioner Doerner submitted photos, for the record, that show <br />burned trees caused by the fire pit at the 161 Triplet Lake Drive <br />residence. <br /> <br />Consensus ofthe Commission was to pass the ordinance because it <br />was in the best interest ofthe Community and that it was not being <br />enacted because of any personal interests initiated on behalf ofthe <br />Commission. <br /> <br />VOTE ON THE MOTION: Carried unanimously on a 5 - 0 voice vote. <br />
