City Commission Meeting July23, 2007 Page 6 MOTION: Moved by Commissioner Jon Miller moved to approve Ordinance 07-1217, Growth Management Initiatives, on first reading for transmittal to the Department of Community Affairs. Motion was seconded by Commissioner Sandra T. Solomon and carried unanimously. (5 - 0) The Commission requested the City Manager schedule work sessions to discuss parks and recreation, trails issues, lakes accessibility and expenditures for the Capital Improvement Plan, i.e. reclaimed water, Fire Department and service fees. 10. First Reading of Ordinances: A. Ordinance 07-1218 - Amendment to City Charter - City Commission Composition The City Clerk read Ordinance 07-1218 by title as follows: "AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, SUBMITTING TO THE ELECTORS OF CASSELBERRY PROPOSED AMENDMENTS TO THE CHARTER OF THE CITY OF CASSELBERRY AT A SPECIAL ELECTION TO BE HELD JANUARY 29, 2008; PROVIDING FOR REVISIONS TO ARTICLE IV, SECTION 10, CREATION OF CITY COMMISSION; COMPOSITION; TERM; ARTICLE IV, SECTION 12, MAYOR; VICE MAYOR; TO CREATE A COMMISSION ELECTED MAYOR; PROVIDING BALLOT TITLES, SUMMARIES AND TEXT FOR THE PROPOSED MANEDMENTS; PROVIDING FOR THE CALL OF A REFERENDUM ELECTION; PROVIDING FOR DIRECTION TO THE CITY CLERK; PROVIDING FOR CONFLICTS, SEVERABILITY; PROVIDING FOR EFFECTIVE DATE FOR APPROVED AMENDMENTS; PROVIDING CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE FOR THE ORDINANCE." Staff Presentation: At the July 9, 2007 meeting, Commission voted 3 - 2 to expand the referendum questions proposed for the January 29,2008 ballot. Ordinance 07-1218 proposes the third amendment which would 'allow for the annual election of the Mayor from among the City Commission Members. Ordinance 07-1218 proposes this question to be included with the two Charter Amendments that were authorized by the Commission with the passage of Ordinance 07- 1214. Staff Recommendation: Approval of Ordinance 07-1218 on first reading and set the Public Hearing for August 13,2007. Audience Input: I) John Casselberry, 700 South Lost Lake Lane, Casselberry, Florida, recommended that Adult Entertainment for future business in the City be included as a referendum question. Correct scriveners error on page I, Fifth Whereas, Line 2 "... .submit said proposed Charter amendments to the voters at a Januarv 29. 2008. special election." MOTION: Moved by Vice Mayor/Commissioner Susan Doerner to approve on first reading, Ordinance 07-1218, Charter Amendment re Annually Electing the Mayor from the Commission Members, as corrected.
