<br />CASSELBERRY CITY COMMISSION <br />Minutes of June 5. 2000 - Regular Meeting <br />Page 5 of17 <br /> <br />The City Clerk read Ordinance 00-989 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING <br />CHAPTER 94 ENTITLED "WATERWAYS"; AMENDING SECTION 94-1, <br />DEFINITIONS, TO CREATE A NEW DEFINITION FRO THE TERM "BOAT"; <br />AMENDING SECTION 94-2, "PENALTY"; AMENDING SECTION 94-11, "WATER <br />SPORTS; SEAPLANES", TO CREATE A NEW SUBPARAGRAPH "F" REGULATING <br />THE MAXIMUM LENGTH OF MOTOR VESSELS; DELETING SECTIONS 94-37 AND <br />94-38 TO DELETE THE CITY REGISTRATION OF BOATS; AMENDING SECTION 94- <br />43, "OPERATION OF PERSONAL WATER CRAFT", TO ADD ADDITIONAL <br />PERSONAL WATER CRAFT REGULATION; PROVIDING FOR CODIFICATION, <br />CONFLICTS, SEVERABILITY AND EFFECTIVE DATE." <br /> <br />The Notice of Public Hearing relative to Ordinance 00-989 was published in the Orlando Sentinel on Sunday, <br />May 21, 2000. Ordinance 00-989 was passed on first reading on May I, 2000. <br /> <br />Chief LaBrusciano stated Ordinance 00-989 would remove any conflicts in the existing water craft <br />regulations with recent court rulings on the subject matter and Attorney General Opinion 88-46, in addition <br />to no longer requiring water craft registration and permits which have been cumbersome to administer and <br />enforce. Staff recommended approval of Ordinance 00-989 on second reading. <br /> <br />Mayor Pronovost asked if there was anyone in the audience that wished to speak either for or against <br />Ordinance 00-989. No one came forward. Mayor Pronovost closed the public hearing. <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to approve and adopt <br />Ordinance 00-989 on second and final reading. Motion <br />was seconded by Commissioner Henson. Motion <br />carried unanimously by roll call vote. <br /> <br />Roll Call Vote of the City Commission: <br /> <br />Commissioner Sheppard - Yes; Commissioner Henson - Yes; Commissioner Hart - Yes; Vice Mayor <br />Clark - Yes; Mayor Pronovost - Yes. Motion passed 5 - O. <br /> <br />AUDIENCE PARTICIPATION <br /> <br />Mayor Pronovost asked if there was anyone in the audience that wished to request participation on any <br />agenda item, or address the Commission on any other matter.
