CITY COMMISSION February 10, 1995 Page 7 - Reconfiguration of Sections: SECTION I. Section 94-38 (a)(2) of the City Code is hereby amended to read IUI follows: There shall be an annual fee set by the City Commission per boat for boats used in conducliog ""uw.ootcial operatiOll8 except fishing. The initial annual registration fee, if registration is applied for after July 1 in any year, shall be $10.00 for boats used in connnen:isl operations except fishing, and the registration fee for all other boats shall be: a) Casselberry resident& - $4,00 b) Non-residents - $15.00 which fees shall be subject to modification from time to time by the City Commission. SECTION II. Section 94-40 of the ClUIselberry City Code is hereby amended by adding new mbparagrapba to be lettered (1) and (j), which subparagraphs shall read IUI follows: I) No motoIboat or boats WJder power shall operate at a speed in excess of 25 milea per hour on any body of water 50 acres in size or leas or on any body with leas than 30 contiguous acres out&ide the shoreline safety zone. J) No motoIboat or boats WJder power shall operate at a speed in excess of 45 milea per hour on any body of water greater in size than SO acres with a minin111tn of 30 contiguous acres oulBide the shoreline safety zone. SECTION m. Section 94-43 of the ClUIselberry City Code is hereby amended by adding new mbparagrapba to be lettered (h), (1), and (J), which subparagraphs shall read IUI follows: h) All personal watercraft shall be restricted to operation on any body of water within the City from 9:00 a.m. to 5:30 p,m.. I) No personal watercraft WJder power shall operate at a speed in excess of 25 milea per hour on any body of water 50 acres in size or leas or on any body of water with leas than 30 contiguous acrea oulBide the shoreline safety zone. j) No personal watercraft WJder power shall operate at a speed in excess of 45 milea per hour on any body of water greater in size than SO acres with a -minimnm of 30 contiguous acres oulBide the shoreline safety zone. SECTION IV. Section 94-36 of the Casselberry City Code shall be amended to read IUI follows: TheprovisiOll8 ofF.S. 327.32 - 327.35, 327.37, 327.38, 327.39, 327.40 - 327.42, 327.44, 327.46, 327.48, 327.50 - 327.52, 327.54, 327.56, 327.60, 327.65, and 327,70 - 327,74 are adopted, as if set forth in this Article, as to the regulation of the operation of motorlloats and water skis within the jurisdiction of the City, and F .S. 327.65 shall also apply to nwfflers and cutouts on outboard motors.
