Mayor Pronovost <br />reiterated his opposition to Ordinance 04-1122 stating he felt resolution of the matter rests with the State <br />Legislature. <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to approve Ordinance 04- <br />1122 on second and final reading as presented. Motion <br />was seconded by Commissioner Doerner. SECOND READING OF ORDINANCE 04-1123 - FUTURE LAND USE - 88 & <br /> <br />100 PLUMOSA AVENUE - LISA MERLIN PROJECT <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to read Ordinance 04-1123 <br />by title only. Motion was seconded by Commissioner <br />Hart. Motion carried unanimously by voice vote. <br /> <br />The City Clerk read Ordinance 04-1123 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, TO AMEND THE <br />CITY OF CASSELBERRY COMPREHENSIVE PLAN, BY AMENDING THE OFFICIAL <br />FUTURE LAND USE MAP ESTABLISHING THE FUTURE LAND USE DESIGNATION <br />OF MEDIUM DENSITY RESIDENTIAL (MDR) FOR THOSE PARCELS DESCRIBED <br />IN SECTION I OF THIS ORDINANCE; PROVIDING FOR CONFLICTS, <br />SEVERABILITY, AND AN EFFECTIVE DATE." <br /> <br />Legal Advertisement: The Notice of Public Hearing relative to Ordinance 04-1123 was published in the <br />Orlando Sentinel on April 15, 2004. <br /> <br />Staff Presentation: Mr. Wells stated the applicant is requesting to change the Future Land Use designation <br />for the subj ecl properties from Low Intensity Non-Residential/Medium Density Residential (LINR/MDR) <br />to MecF~um Density Residential (MDR). The change will eliminate the required 3 acre miff~mum lot size as <br />well as the requirement for a conditional use approval for a community residential home, which is the use <br />proposed by the applicant. The Planning & Zoning Commission/Land Planning Agency recommended <br />approval of Ordinance 04-1123 at its February 25, 2004 meeting by a 4 - 1 vote.
