SECOND READING OF ORDINANCE 04-1126 - ANNEXATION OF CVS <br /> PHARMACY PROPERTY <br /> <br />The City Clerk read Ordinance 04-1126 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO AND <br />INCLUDING WITHIN THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, <br />FLORIDA, CERTAIN LANDS LOCATED IN SECTION 17, TOWNSHIP 21S, RANGE <br />30E, REDEFINING THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, <br />FLORIDA; PROVIDING FOR THE INTERIM PROVISION OF LAND DEVELOPMENT <br />REGULATIONS; PROVIDING THAT CERTAIN COUNTY LICENSEES FOLLOWING <br />THEIR BUSINESS, TRADE OR PROFESSION WITHIN THE LANDS TO BE <br />ANNEXED MAY CONTINUE TO FOLLOW SUCH BUSINESS, TRADE OR <br />PROFESSION THROUGHOUT THE ENTIRE CORPORATE LIMITS WITHOUT THE <br />NECESSITY OF FURTHER QUALIEICATION THEREFORE; PROVIDING THAT <br />EFFECTIVE IN ACCORDANCE WITH LAW, THE LANDS TO BE ANNEXED SHALL <br />BE ASSESSED FOR PAYMENT OF MUNICIPAL AD VALOREM TAXES; DIRECTING <br />THE CITY CLERK TO FILE CERTIFIED COPIES OF THE ORDINANCE WITH THE <br />CLERK OF COURT AND PROVIDING FOR CODWICATION, CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Legal Advertisement: The Notice of Public Hearing relative to Ordinance 04-1126 was published in the <br />Orlando Sentinel on April 2 and April 8, 2004. <br /> <br />Staff Presentation: Mr. Wells stated Ordinance 04-I 126 provides for annexation of a parcel of land located <br />at the southeastern comer of State Road 436 and Oxford Road. The property currently contains a former <br />Texaco gas station and the purchasers, CVS Pharmacy, plan to combine the subject property with <br />approximately 0.8 acres from the surrounding Sun Trust property to create a site that is of sufficient size to <br />accommodate a new CVS Pharmacy. The subject property is adjacent to city limits, will not create an <br />enclave and generally meets the statutory criteria for annexation as established in Chapter 171, Florida <br />Statutes. Staffrecommended approval of Ordinance 04-1126 on second reading. <br /> <br />Public Hearing: Mayor Pronovost asked if there was anyone in the audience that wished to address <br />Ordinance 04-1126. No one came forward. Mayor Pronovost closed the public hearing. <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to approve Ordinance 04- <br />1126 on second and final reading as presented. Motion <br />was seconded by Commissioner Hart. Motion carried <br />unanimously by roll call vote. <br /> <br />Roll Call Vote of the City Commission: <br /> <br /> Commissioner Doemer - Yes; Commissioner Cook - Yes; Commissioner Hart - Yes; Vice Mayor <br /> Clark - Yes; Mayor Pronovost - Yes. Motion passed 5 - 0. <br /> <br /> <br />
