CASSELBERRY CITY COMMISSION <br />Minutes of May 1O, 2(}04 - Regular Meeting <br />Page 8 of 17 <br /> <br />CORPORATE LIMITS OF THE CITY OF CASSELBERRY, FLORIDA; PROVIDING <br />FOR THE 1NTERIM PROVISION OF LAND DEVELOPMENT REGULATIONS; <br />PROVIDING THAT CERTAIN COUNTY LICENSEES FOLLOWING THEIR <br />BUSINESS, TRADE OR PROFESSION WITHIN THE LANDS TO BE ANNEXED MAY <br />CONTINUE TO FOLLOW SUCH BUSINESS, TRADE OR PROFESSION <br />THROUGHOUT THE ENTIRE CORPORATE LIM1TS WITHOUT THE NIECESSITY OF <br />FURTHER QUALIFICATION THEREFORE; PROVIDING THAT THE LANDS TO BE <br />ANNEXED SHALL BE ASSESSED FOR PAYMENT OF MUNICIPAL AD VALOREM <br />TAXES PURSUANT TO LAW; PROVIDING FOR SUBMISSION OF THE QUESTION <br />OF ANNEXATION OF SAID LANDS INTO THE CITY OF CASSELBERRY AND <br />WITHIN THE LANDS TO BE ANNEXED AT AN ELECTION TO BE HELD JULY 13, <br />2004; PROVIDING FOR A POLLING PLACE AND A CANVASSING BOARD; <br />DIRECTING THE CITY CLERK TO FILE CERTIFIED COPIES OF THE ORDINANCE <br />WITH THE CLERK OF COURT AND THE SECRETARY OF STATE OF THE STATE <br />OF FLORIDA; AND PROVIDING FOR CODIFICATION, CONFLICTS, <br />SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />Legal Advertisement: The Notice of Public Hearing relative to Ordinance 04-I131 was published in the <br />Orlando Sentinel on April 29, 2004. <br /> <br />Staff Presentation: Mr. Wells stated in accordance with Section 171.0413, Florida Statues, Ordinance 04- <br />1131 provides for a referendum for annexation of Lake Howell Condominiums located on State Road 436 <br />west of Lake Howell and south of Red Bug Lake Road. The Lake Howell Condominium Association Board <br />of Directors, expressed a desire of annexing into the City. City staff prepared an urban services plan in <br />support of the annexation and provides basis for the referendum. The subject annexation area generally <br />meets the statutory criteria for annexation as established in Chapter 171, Florida Statutes. If adopted, a <br />special referendum election will be held among the registered voters of the lands to be annexed on July 13, <br />2004. The election will be held in the City Commission Chambers in City Hall from 7 a.m. to 7 p.m. <br />Majority vote of the eligible registered voters will determine whether or not the subject lands are annexed <br />into the City. Staff recommended approval of Ordinance 04-1131 on first reading. <br /> <br />Public Hearing: Mayor Pronovost asked if there was anyone in the audience that wished to speak either <br />for or ag~fmst OrcFmance 04-1131. The following incF~viduals came forward: <br /> <br />1) John Casselberry, 700 South Lost Lake Lane, spoke in favor of Ordinance 04-1131 <br />stating it would enable the City to improve lake water management of Lake Howell. <br /> <br />2) Jennie Musser, 106 Long Horn Road, Winter Park (unincorporated Seminole County), <br />stated she was a member of the Board of Directors for Lake Howell Condominiums and <br />owns 19 units within the subject property. Ms. Musser stated she did not vote in favor of <br />the annexation and was opposed to Ordinance 04-1131. <br /> <br />No one else came forward. Mayor Pronovost closed the public hearing. <br /> <br />MOTION: <br /> <br />Vice Mayor Clark moved to approve Ordinance 04- <br />1131 on first reading as presented. Motion was <br />seconded by Commissioner Doerner. Motion carried <br />unanimously by roll call vote. <br /> <br /> <br />
