<br />RESOLUTION 05 -1612 <br /> <br />"A RESOLUTION OF THE CITY OF CASSELBERRY, FLORIDA, AUTHORIZING <br />CLOSING, VACATING AND ABANDONING THE SOUTH THREE (3) FEET OF A <br />SEVEN (7) FOOT UTILITY EASEMENT ON LOT 8, ALEXANDER PLACE, AS <br />RECORDED IN PLAT BOOK 23, PAGE 36 (ALSO KNOWN AS 516 IVANHOE WAY), <br />PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA; PROVIDING FOR <br />CONFLICTS, SEVERABILITY, AND EFFECTIVE DATE." <br /> <br />WHEREAS, a petition was filed with the City Commission of the City of Casselberry, <br />Florida, to close, vacate and abandon the south three (3) feet of a seven (7) foot utility easement, <br />more particularly described on Exhibit "A"; and <br /> <br />WHEREAS, all affected utilities have reviewed the petition; and <br /> <br />WHEREAS, the City Commission finds that the closing, vacating and abandoning a <br />portion of said easement will not present a detriment to either the City of Casselberry, Florida, or <br />the public. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE <br />CITY OF CASSELBERRY, FLORIDA, AS FOLLOWS: <br /> <br />Section I. The City Commission of the City of Casselberry hereby approves the closing, <br />vacating and abandonment of the South three (3) feet of the seven (7) foot rear utility easement <br />described on Exhibit "A" in the City of Casselberry as of this date and the City Commission of the <br />City of Casselberry, Florida, renounces any rights in and to the afore-described utility easement, <br />attached as "Exhibit A", and authorizes the Mayor to sign the resolution. <br /> <br />Section II. Conflicts. All Resolutions or parts of Resolutions in conflict with any of the <br />provisions of this Resolution are hereby repealed. <br /> <br />Section III. Severabilitv. If any Section or portion of a Section of this Resolution proves to <br />be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, <br />or effect of any other Section or part of this Resolution. <br /> <br />Section IV. Effective Date.
