FIRST READING OF ORDINANCE 04-1127 - ANNEXATION OF HARTMAN <br /> <br />PROPERTY - MARION LANE <br /> <br />MOTION: <br /> <br />Commissioner Doerner moved to read Ordinance 04- <br />1127 by title only. Motion was seconded Commissioner <br />Cook. Motion carried unanimously by voice vote. <br /> <br />The City Clerk read Ordinance 04-1127 by title as folllows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, RELATING TO <br />VOLUNTARY ANNEXATION; MAKING FINDINGS; ANNEXING TO ANVD <br />INCLUDING WITHIN THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, <br />FLORIDA, CERTAIN LANDS LOCATED IN SECTION 5, TOWNSHIP 21S, RANGE <br />30E; REDEFINING THE CORPORATE LIMITS OF THE CITY OF CASSELBERRY, <br />FLORIDA; PROVIDING FOR THE INTERIM PROVISION OF LAND DEVELOPMENT <br />REGULATIONS; PROVIDING THAT CERTAIN COUNTY LICENSEES FOLLOWING <br />THEIR BUSINESS, TRADE OR PROFESSION WITHIN THE LANDS TO BE <br />ANNEXED MAY CONTINUE TO FOLLOW SUCH BUSINESS, TRADE OR <br />PROFESSION THROUGHOUT THE ENTIRE CORPORATE LIMITS WITHOUT THE <br />NECESSITY OF FURTHER QUALIFICATION THEREFORE; PROVIDING THAT <br />EFFECTIVE IN ACCORDANCE WITH LAW, THE LANDS TO BE ANNEXED SHALL <br />BE ASSESSED FOR PAYMENT OF MUNICIPAL AD VALOREM TAXES; DIRECTING <br />THE CITY CLERK TO FILE CERTIFIED COPIES OF THE ORDINANCE WITH THE <br />CLERK OF COURT AND THE SECRETARY OF STATE OF THE STATE OF <br />FLORIDA; AND PROVIDING FOR CODIFICATION, CONFLICTS, SEVEKABILITY, <br />AND EFFECTIVE DATE." <br /> <br />Staff Presentation: Mr. Wells stated Ordinance 04-1127 provides for annexation of a parcel of land located <br />north of Lake Kathryn and east of U.S. Highway 17-92. The property currently contains a single family <br />home that is vacant. The purchasers, Hartman, plan to subdivide the property into three residential lots, <br />renovate thc existing home and build two new homes. The subject property is adjacent to city limits, will <br />not create an enclave and generally meets the statutory criteria for annexation as established in Chapter 171, <br />Florida Statutes. Staff recommended approval of Ordinance 04-1127 on first reading. <br /> <br /> <br />
