ORDINANCE 04-1120 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, <br />FLORIDA, AMENDING SECTIONS 10-2, HOURS OF SALE <br />GENERALLY, AND SECTION 10-3, CLOSING <br />PROCEDURES, OF CHAPTER 10, ALCOHOLIC <br />BEVERAGES, OF THE CODE OF ORDINANCES TO <br />ELIMINATE THE PROVISION OF THIRTY (30) ADDITIONAL <br />MINUTES FOR CONSUMPTION PURPOSES; PROVIDING <br />FOR SEVERABILITY, CODIFICATION, CONFLICTS AND <br />EFFECTIVE DATE. <br /> <br /> WHEREAS, the vast majority of all municipalities in the Central Florida area require <br />that alcoholic beverages at establishments with alcoholic beverage licenses must be <br />consumed by 2:00 a.m.; and <br /> <br /> WHEREAS, the current City of Casselberry code provides that sales shall cease at <br />2:00 a.m., but consumption need not cease until 2:30 a.m.; and <br /> <br /> WHEREAS, the City Commission of the City of Casselberry desires to change to a <br />2:00 a.m. consumption limitation to be consistent with the other municipalities and clarify <br />enforcement of the ordinance by the City's police department; and <br /> <br /> WHEREAS, the City Commission of the City of Casselberry also finds it to be in the <br />best interests of the citizens of Casselberry to provide that all alcoholic beverages must be <br />consumed by 2:00 a.m. at establishments, to protect the citizens' public health, safety and <br />welfare and to prevent alcohol related crimes and accidents; and <br /> <br /> WHEREAS, words with double underlined type shall constitute additions to the <br />original text and ct;!.u.c through shall constitute deletions to the original text. <br /> <br /> NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA AS FOLLOWS: <br /> <br /> SECTION ONE: Section 10-2, Hours of sale generally, of Chapter 10, Alcoholic <br />Beverages, of the Code of Ordinances of the City of Casselberry, Florida, is hereby <br />amended as follows: <br /> <br />Sec. 10-2. Hours of sale and consumotion generally. <br /> <br />(a) <br /> <br />Within the meaning of this Section, the sale of alcoholic <br />beverages shall include the service or delivery of alcoholic <br />beverages to customers during prohibited hours, regardless of <br /> <br />Ordinance No. 04-1120 <br />Page No. 1 <br /> <br /> <br />
