ORDINANCE 04-1119 <br /> <br />AN ORDINANCE OF THE CI'P/OF CASSELBERRY, <br />FLORIDA, RELATING TO OPEN OR UNSEALED <br />ALCOHOLIC BEVERAGES; ESTABLISHING SECTION <br />10-9, "THE CASSELBERRY OPEN OR UNSEALED <br />ALCOHOLIC BEVERAGE CODE"; OF CHAPTER 10 OF <br />THE CITY CODE OF ORDINANCES; PROVIDING FOR <br />DEFINITIONS; PROVIDING FOR POSSESSION OR <br />CONSUMPTION PROHIBITED; INAPPLICABILITY / <br />EXCEPTIONS; AND ENFORCEMENT; AND PENALTY; <br />PROVIDING FOR SEVERABILITY, CODIFICATION, <br />CONFLICTS AND EFFECTIVE DATE. <br /> <br /> WHEREAS, the City Commission of the City of Casselberry desires to provide for <br />the health, safety and welfare of the residents of the City of Casselberry; and <br /> <br /> WHEREAS, the City Commission of the City of Casselberry has recognized that <br />there is a direct relationship between motor vehicle accidents and the consumption of <br />alcohol; and <br /> <br /> WHEREAS, the City Commission of the City of Casselberry has determined that the <br />consumption of alcoholic beverages while driving or riding in or on a motor vehicle poses <br />an imminent hazard to the residents of, and visitors to, the City of Casselberry; and <br /> <br /> WHEREAS, the City Commission of the City of Casselberry has determined that the <br />prohibition of the possession of open alcoholic beverage containers and the consumption <br />of alcoholic beverages in motor vehicles will reduce the danger of motor vehicle accidents <br />and promote the public health, safety and welfare; and <br /> <br /> WHEREAS, prohibiting such possession and consumption would not be inconsistent <br />with general or special law; and <br /> <br /> WHEREAS, this Ordinance is enacted under authority of Chapter 166, Florida <br />Statutes, and under authority of the general Home Rule Power of the City of Casselberry in <br />the interest of public health, safety and general welfare of the citizens of the City of <br />Casselberry and to be applied and enforced in the City of Casselberry. <br /> <br /> NOW THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY <br />OF CASSELBERRY, FLORIDA AS FOLLOWS: <br /> <br /> SECTION 1. Chapter 10, Alcoholic Beverages, of the City Code of Ordinances is <br />amended to add Section 10-9, Open or Unsealed Alcoholic Beverage, to read as follows: <br /> <br />Section 10-9.
