Wells, AICP, Director <br />95 Triplet Lake Drive <br />Casselberry, FL 32707 <br /> <br />ORDINANCE # 03-1078 <br /> <br />AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE CITY OF <br />CASSELBERRY, FLORIDA, UNIFIED LAND DEVELOPMENT REGULATIONS TABLE 2-5.3, LAND USE <br />BY DISTRICT, AS ESTABLISHED IN ARTICLE V, SECTION 2-5.2, AS AMENDED AND <br />SUPPLEMENTED; ALLOWING AS A CONDITIONAL USE VEHICULAR SERVICES, MAINTENANCE <br />AND LIGHT MECHANICAL REPAIRS IN THE PMX-H ZONING DISTRICT; CREATING SECTION 2-7.27 <br />VEHICULAR SERVICES, MAINTENANCE, AND LIGHT MECHANICAL REPAIR IN THE PMX-H AND <br />PMX-L ZONING DISTRICTS, ESTABLISHING DESIGN CRITERIA TO REDUCE NEGATIVE IMPACTS; <br />PROVIDING FOR CONFLICTS, SEVERABILITY, CODIFICATION AND AN EFFECTIVE DATE. <br /> <br />Whereas, vehicular services are common and necessary services provided in commercial areas; <br /> <br />and <br /> <br />and <br /> <br />Whereas, vehicular services are allowed as a conditional use in the CG and PMX-L zoning districts; <br /> <br />Whereas, the PMX-L district is a less intense use district than PMX-H, and therefore the PMX-H <br />district should also allow qualified vehicular services; <br /> <br />Whereas, vehicular services have specific negative impacts to residential properties; and <br /> <br />Whereas, the PMX-H and PMX-L zoning districts are mixed use districts and criteria are needed to <br />reduce negative impacts between uses; and <br /> <br />Whereas, a Public Hearing on the question of establishing conditions for permitting vehicular <br />services within the PMX-H and PMX-L zoning classifications has been duly held in the City of Casselberry, <br />Florida and at such hearing, interested parties and citizens for and/or against the proposed establishment <br />of zoning classification were heard; and <br /> <br />Whereas, after said Public Hearing, the City Commission of the City of Casselberry, Florida, has <br />determined these uses shall be allowed as a conditional use in the PMX-H zoning district in Table 2-5.3, <br />Land Use by District, in Article V of Chapter II, and design criteria shall be provided in Article VII, Chapter II, <br />Section 2-7.27, Vehicular Services, Maintenance and Light Mechanical Repair for the PMX-H and PMX-L <br />Zoning Districts in the Unified Land Development Regulations, Code of Ordinances of the City of <br />Casselberry, Florida. <br /> <br />NOW, THEREFORE, BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF CASSELBERRY, <br />FLORIDA, AS FOLLOWS: <br /> <br />Ordinance # 03-1 078 <br />Page 1 of 3 <br />
