<br />5. Tracts C and J on the above referenced recorded plat satisfy all recreation requirements of the <br />subdivision pursuant to the Agreement of Compromise regarding the Brittany Garden Subdivision <br />executed in October of 1998. <br /> <br />6. A homeowner's association has been established to maintain all common areas within the <br />development including private road right-of-ways, all open space and recreational facilities pursuant <br />to the Declaration of Covenants, Conditions, and Restrictions were recorded in Book 2915 and Page <br />] 693 of the Public Records of Seminole County, Florida. The Brittany Gardens Homeowner's <br />Association and by-laws were created and recorded in Book 2598 Pages 0533 through 0549 of the <br />Public Records of Seminole County, Florida. <br /> <br />7. Unless specifically addressed in this Ordinance, this development shall fully comply with all City of <br />Casselberry codes and ordinances including impact fees ordinances in effect at the time of issuance <br />of any building permit. <br /> <br />8. A waiver from new Surface Water Management Standards (Ordinance 89-3 enacted February 14, <br />1989) has been approved by Seminole County Engineering, as Preliminary Plans were designed and <br />approved based on previous criteria (Previous Land Development Code; Chapter 6: Subdivision <br />Regulations; Article IV: Designed Standards; Section 6.4.6- Drainage Systems) has been granted. <br /> <br />SECTION II. Codification.. It is the intention of the City Commission of the City of Casselberry, <br />Florida, and it is hereby ordained that the provisions of this Ordinance shall become and be made a part of the <br />City of Casselberry, Florida; adopted zoning map. <br /> <br />SECTION III. Confficts. All Ordinances or parts of Ordinances in conflict with any of the <br />provisions of this Ordinance are hereby repealed. This Ordinance will effectly rescind and replace the <br />Developer's Agreement for the Brittany Gardens subdivsion dated August 8, 1989. <br /> <br />SECTION IV. Severability. If any Section or portion of a Section of this Ordinance proves to be <br />invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the validity, force, or effect <br />of any other Section or part of this Ordinance. <br /> <br />SECTION V. Effective Date. This Ordinance shall become effective ten (IO) days after its passage <br />and adoption.
