FL. <br /> <br />UTILITY AND DRAINAGE EASEMENT <br /> <br />THIS INDENTURE made and executed this ~day of JUly, <br />1981 by COMBANK/WINTER PARK, a banking corporation organized <br />the existing under the laws of the State of Florida, AS <br />TRUSTEE (hereinafter referred to as "Grantor") to and in <br />favor of THE CITY OF CASSELBERRY, FLORIDA, a political <br />subdivision of the State of Florida (hereinafter referred to <br />as "Grantee"). <br /> <br />WIT N E SSE T H: <br /> <br />THAT for and in consideration of the sum of Ten Dollars <br />($10.00) and the good and valuable considerations in hand <br />paid to the Grantor by the Grantee, the receipt and suffi- <br />ciency hereof is hereby acknowledged, Grantor does hereby <br />grant, bargain, sell and convey unto Grantee a non-exclusive <br />right-of-way and easement for and the right from time to <br />time hereafter to erect, install, lay and thereafter use, <br />maintain, operate, inspect, repair, replace, increase or <br />decrease the size of and remove various types of lines, <br />mains, pipes, conduits and other fixtures and appurtenances <br />used for the purposes of (1) transmitting and/or distrib- <br />uting water, sewage, gas, electricity, telephone and other <br />types of utility services designed to serve the public and <br />(2) retaining, transmitting and draining surface storm <br />waters over and across the fOllowing-described parcels of <br />land situate in Seminole County, Florida, to wit: <br /> <br />Begin at the point of intersection of the south- <br />erly right-of-way line of State Road No. 436 and <br />the westerly right-of-way line of Kewannee Trail, <br />run thence southwesterly along the westerly right- <br />of-way line of Kewannee Trail a distance of 300 <br />feet, run thence northwesterly along a line par- <br />allel with and 300 feet southwesterly from the <br />aforesaid southerly right-of-way line of State <br />Road No. 436 a distance of 75 feet; run thence <br />northeasterly along a line parallel with and 75 <br />feet northwesterly of the westerly right-of-way <br />line of Kewannee Trail a distance of 300 feet more <br />or less to the southerly right-of-way line of <br />State Road No. 436; run thence southeasterly along <br />the southerly right-of-way line of State Road No. <br />436 a distance of 75 feet more or less to the <br />point of beginning. <br /> <br />AND <br /> <br />Begin at the point of intersection of the south- <br />erly right-of-way line of State Road No. 436 and <br />the easterly right-of-way line of Kewannee Trail <br />run thence southwesterly along the easterly right- <br />of-way line of Kewannee Trail a distance of 300 <br />feet; run thence southeasterly along a line par- <br />allel with and 300 feet southwesterly from the <br />aforesaid southerly right-of-way line of State <br />Road No. 436 a distance of 75 feet; run thence <br />northeasterly along a line parallel with and 75 <br />feet southeasterly of the easterly right-of-way <br />line of Kewannee Trail a distance of 300 feet more <br />or less to the southerly right-of-way line of <br />State Road No. 436; run thence northwesterly along <br />the southerly right-of-way line of State Road 436 <br />a distance of 75 feet more or less to the point of <br />beginning.
