PART II. CHAPTER 26 - BUSINESSES. ARTICLE II. OCCUPATIONAL <br />LICENSE TAX - CHANGE IN TERMINOLOGY <br /> <br />The City Clerk read Ordinance 06-1206 by title as follows: <br /> <br />"AN ORDINANCE OF THE CITY OF CASSELBERRY, FLORIDA, AMENDING THE <br />CASSELBERRY CODE OF ORDINANCES, PART II, CHAPTER 26, "BUSINESSES", <br />ARTICLE II, "OCCUPATIONAL LICENSE TAX", DELETING THE TERM <br />"OCCUPATIONAL LICENSE TAX" AND REPLACING WITH THE TERM "LOCAL <br />BUSINESS TAX"; DELETING THE TERM "OCCUPATIONAL LICENSE" AND <br />REPLACING WITH THE TERM "LOCAL BUSINESS TAX RECEIPT" OR "RECEIPT"; <br />REPEALING SECTION 26-29, "OCCUPATIONAL LICENSE REVIEW BOARD"; <br />PROVIDING CONSISTENT TERMINOLOGY THROUGHOUT THE CHAPTER; <br />PROVIDING MINOR FORMATTING EDITS; PROVIDING FOR CODIFICATION, <br />CONFLICTS, SEVEABILITY AND AN EFFECTIVE DATE." <br /> <br />Legal Advertisement: The notice of public hearing relative to Ordinance 06-1206 was published in the <br />Orlando Sentinel on September 13, 2006. <br /> <br />Staff Presentation: Eugene Miller, Interim City Manager, stated Ordinance 06-1206 provides consistency <br />between the City Code and the recently approved mandates of Florida Statutes, Chapter 205. Sandra Smith, <br />Acting Community Development Director, stated that prior to the meeting Commissioner Cook indicated the <br />following scrivener's errors contained in Ordinance 06-1206: <br /> <br />Section 13: Sec. 26-39. First line - Strike through second word "business". <br /> <br />Proper additions and deletions of the term "receipt" throughout the ordinance. <br /> <br />Section 18: (d). Delete the term "fee". <br /> <br />Section 18: (g). Eliminate the strikethrough of the term "new" and reinsert. <br /> <br />Budget Impact: This ordinance has no impact on the City's budget. <br /> <br />Recommendation: The Interim City Manager and the Acting Community Development Director <br />recommended approval of Ordinance 06-1206 on first reading as corrected. <br /> <br />Public Hearing: Mayor Goff opened the public hearing for Ordinance 06-1206. No one came forward. <br />Mayor Goff closed the public hearing. <br /> <br />MOTION: <br /> <br />Commissioner Doerner moved to approve Ordinance <br />06-1206 on first reading as corrected. Motion was <br />seconded by Vice Mayor Hart. Motion carried <br />unanimously 5 - 0 by voice vote. <br />
